CEASE AND DESIST ORDERNO. 99-051 -3- <br /> CITY OF MANTECA AND CITY OF LATHROP <br /> SAN JOAQUIN COUNTY <br /> 9. Since the adoption of Order 97-115 in June 1997 and continuing through March 1999,the City of <br /> Manteca violated the Order's effluent bioassay requirement, with many test results reported as 0 % <br /> survival. In April 1998, the City began to operate the plant to partially nitrify. However, plant <br /> operations alone have not demonstrated continuous compliance with Order 97-115. The City of <br /> Manteca is working to find a solution within their resources to the permit'violations. The City of <br /> Manteca will continue to conduct additional studies and/or corrective.measures. One of the possible <br /> corrective actions is the construction of the treatment plant expansion to include full nitrification. <br /> The blending of the old and new plant effluents would reduce the ammonia concentrations of the <br /> combined effluent discharge to the river. The Discharger is presently conducting receiving water <br /> studies to evaluate the effects or impacts if any of the discharge on ambient water and species. <br /> 10. On 30 April 1999, in Sacramento, California, after due notice to the Discharger and all other affected <br /> persons, the Board conducted a public hearing at which evidence was received to consider a Cease <br /> and Desist Order to establish a time schedule to achieve compliance with waste discharge <br /> requirements. <br /> 11. Issuance of this order is exempt from the provisions of the California Environmental Quality Act <br /> (Public Resources Code, Section 21000, et seq.), in accordance with Section 15321 (a)(2), Title 14, <br /> California Code of Regulations. <br /> 12. Any person adversely affected by this action of the Board may petition the State Water Resources <br /> Control Board(Sate Board)to review the action. The petition must be received by the State Board <br /> Office of the Chief Counsel, P.O. Box 100, Sacramento, California 95812-0100, within 30 days of <br /> the date which the action was taken. Copies of the law and regulations applicable to filing petitions <br /> will be provided on request. <br /> IT IS HEREBY ORDERED THAT: <br /> 1. Cease and Desist Order No. 98-169 is hereby rescinded. <br /> 2. The City of Manteca and City of Lathrop, shall cease and desist discharging wastes in violation of <br /> Waste Discharge Requirements Order No. 97-115 (NPDES NO. CA0081558),.Effiuent Limitation <br /> C.S. <br /> 3. The Discharger shall implement a permit compliance workplan. The City of Manteca shall identify <br /> and implement changes required at the wastewater treatment plant to ensure reliable compliance with <br /> Waste Discharge Requirements Order 97-115 forthwith, but in no event later than the date provided <br /> in the following schedule: <br /> 19a$ Due Date <br /> Submit results of receiving water toxicity study as described in 1 June 1999 <br /> Finding 5 <br /> Report on methods to be used to bring the plant into compliance with 1 March 2000 <br /> Order 97-115 <br />
