Order No. 97-115 and Order No. 5-01-007 include, in part, the following effluent limitations: <br /> EFFLUENT LIMITATIONS: <br /> 1. The discharge shall not have a pH less than 6.5 nor greater than 8.5. <br /> 4. According to monitoring reports submitted by the Discharger, the Discharger committed four(4) <br /> serious violations during the period beginning 1 January 2000 and ending on 31 March 2004. <br /> Total Settleable Solids and Biochemical Oxygen Demand(BOD) are listed as a Group I <br /> pollutants in Title 40 of the Code of Federal Regulations. The City of Manteca Water Quality <br /> Control Facility discharged effluent that exceeded the daily maximum effluent limitations for <br /> settleable solids and BOD by 40 percent or more. Chlorine Residual is listed as a Group II <br /> pollutant in Title 40 of the Code of Federal Regulations. The City of Manteca Water Quality <br /> Control Facility discharged effluent that exceeded the hourly average effluent limitation for <br /> chlorine residual by 20 percent or more. <br /> The amount of the mandatory penalty for these serious violations is $12,000. <br /> 5. According to monitoring reports submitted by the Discharger, the Discharger also had a total of <br /> 31 violations of effluent limitations that were not considered serious violations (suspended <br /> solids, total coliform, BOD, settleable solids, and pH). However, nine (9) of the violations are <br /> exempt from the mandatory minimum penalty under CWC Section 13385(1) (i.e. fall under the <br /> category of first three violations in any six consecutive month period). The amount of the <br /> mandatory penalty for the remaining 22 non-serious violations is therefore $66,000. <br /> 6. The total amount of the mandatory penalty(for serious +non-serious) is $78,000. <br />
