STATE NONPOINT SOURCE POLLUTION CONTROL PROGRAM <br /> The purpose of California's Nonpoint Source Pollution Control Program Plan is to improve the state's ability to <br /> effectively manage nonpoint source pollution and to conform to the requirements of the federal Clean Water Act <br /> and the federal Coastal Zone Act Reauthorization Amendments of 1990. The plan was developed by staffs of the <br /> SWRCB and the California Coastal Commission in coordination with the RWQCBs and staffs from more than 20 <br /> other state agencies. The plan was submitted for final federal approval to the U.S.Environmental Protection <br /> Agency and the National Oceanic and Atmospheric Administration in February 2000 and was approved in July <br /> 2000. <br /> STATE STORM WATER PROGRAM <br /> California's storm water program is administered by the SWRCB's Division of Water Quality.NPDES permits, <br /> General Permits for Storm Water Discharges from Construction Activity, and other permits are issued as part of <br /> this program. <br /> CENTRAL VALLEY RWQCB CONDITIONAL WAIVER FOR AGRICULTURAL DISCHARGES <br /> Agricultural discharges are exempt from Clean Water Act requirements to obtain NPDES permits or waste <br /> discharge requirements (WDRs). Such discharges are not exempt from State waste discharge requirements,but <br /> have been allowed under conditional waivers of WDRs. The previously existing waiver expired on January 1, <br /> 2003,as a result of legislation adopted in 2002. Waivers may not extend for more than 5 years. The Central <br /> Valley RWQCB adopted a new 2-year conditional waiver that applies to irrigation return flows and storm runoff <br /> from agricultural fields. The conditional waiver requires agricultural interests to form watershed groups and <br /> conduct monitoring,with implementation of BMPs to follow. If they do not participate in watershed groups, <br /> individual agricultural dischargers are required to file a Notice of Intent with the RWQCB that provides details of <br /> a pollution management plan. <br /> In addition,the conditional waiver requires: <br /> ► Demonstration that discharges of waste from irrigated lands shall not cause or contribute to conditions of <br /> pollution of nuisance, as defined. <br /> ► Demonstration that discharges of waste from irrigated lands shall not cause or contribute to exceedances of <br /> any regional, state, or federal numeric or narrative water quality standard. <br /> The RWQCB decided to develop a 10-year implementation program to ensure that water quality standards are <br /> met, and undertook an associated EIR process. <br /> CHANGES IN COORDINATED CVP/SWP OPERATIONS <br /> Members of the California Water Policy Council and the California Federal Ecosystem Directorate (CALFED) <br /> signed the Framework Agreement in 1994. By signing this agreement,participants were committed to setting <br /> water quality standards for the Bay-Delta estuary, developing long-term solutions for the Bay-Delta, and <br /> coordinating CVP and SWP operations with requirements for endangered species,water quality, and the Central <br /> Valley Project Improvement Act. The CALFED Operations Group(Ops Group)coordinates water project <br /> operations with the requirements of the SWRCB's Decision 95-6,the biological opinions for the Delta smelt and <br /> winter-run salmon, and the CVPIA. The Ops Group oversees three areas of project operations: <br /> ► the adjustment of export limits to minimize take of endangered species or to improve fishery conditions in <br /> general; <br /> Manteca WQCF and Collection System Master Plans EIR EDAW <br /> City of Manteca 5-9 Cumulative Impacts <br />
