I'd just like to confirm some of our talking points:
• Before 10/1/2018, Federal UST regulations required inspection of overfill equipment [40 CFR §280.35(a)(2)]
• If we did an overfill equipment inspection before 10/1/2018, it may be used to satisfy the California requirement
to first inspect by 10/13/2018 [23 CCR§2637.2(a)(1)(A)], provided the following are true:
o The inspection ensures the equipment is set to activate at the correct level, and will activate when
substance reaches that level
o The inspection is performed according to either manuf guidelines/standards or industry code (PEI
RP1200)
o The inspection was recorded and documented in any format
• If we do an overfill equipment inspection after 10/1/2018, it will be performed in accordance with section
2637.2 of title 23 of the California Code of Regulations. (this section includes the requirement to use the Overfill
Prevention Equipment Inspection From)
1
