A permit to operate the UST system has not been issued. No person may own or operate an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the UST system. Immediately obtain a permit to operate a UST system from the EHD. An"Operating without a Permit' penalty may apply. This is a Class I violation. 102 HSC 25284(a)(3)(A)/(B) No written agreement between tank owner and tank operator to monitor the tank system. The annual operating permit is not issued to the current operator and there is no written agreement between the person who was issued the permit and the operator to monitor the UST system. If a permit is issued to a person other than the operator of the tank, that person shall enter into a written agreement with the operator of the tank to monitor the UST system. Immediately submit a copy of this written agreement to the EHD. Alternatively, log into CERS, upload the written agreement, and submit for review by the EHD. This is a Class II violation. 103 HSC 25292.2, 25299.30 Failure to submit and maintain complete and current financial responsibility documents. Current financial responsibility documents have not been submitted to the EHD. The Certification of Financial Responsibility document on CERS is dated 7-5-17. The insurance documents are dated through 7-1-18. Current financial responsibility documents are required to be submitted annually. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, and upload the required documents. This is a Class II violation. 104 CCR 2711 UST operating permit application for facility and tank information not submitted or current. UST Facility Operating Permit is not current in CERS. -The California Department of Tax and Fee Administration (CDTFA, previously BOE) number listed on CERS is not associated with the new owner. Any change of information must be updated in CERS within 30 days of the changes. Immediately log into CERS, update the required information, and submit for review by the EHD. The UST Tank Information form for the diesel tank is not current in CERS. -No tank manufacturer is listed. -The installation date is incorrect. -The tank form states that no striker plates are installed. According to 23 CCR 2631(c), all primary containment shall have wear plates installed below all accessible openings. Verify that the correct information is submitted and update the forms or tanks as required. Any change of information must be updated in CERS within 30 days of the changes. Immediately log into CERS, update the required information, and submit for review by the EHD. This is a Class II violation.
