The <br /> responsible party, Mr. Phillip Elder, is out of compliance pursuant to California Code of <br /> Regulations, Division 3, Chapter 16, Article 11, having failed to comply with directives from <br /> the EHD to: <br /> • Submit reports to this department and to GeoTracker, the State Water Resources <br /> Control Board database program, for prior monitoring and sampling events; <br /> • Restart the pump-and-treat remediation system using extraction wells EW-1 <br /> through EW-3; <br /> • Resume monitoring and sampling; <br /> • Submit a work plan to perform a soil vapor extraction feasibility study to evaluate <br /> the potential for soil vapor extraction to mitigate the remaining soil mass in the <br /> vadose zone; and <br /> • Submit a work plan for advancement of a boring/borings down gradient of <br /> monitoring well MW-11 to delineate the extent of the dissolved methyl tertiary-butyl <br /> ether(MTBE) plume. <br /> Mr. Elder has a long history of not complying with directives from the EHD. By letter dated <br /> 03 December 1999, the EHD had given Mr. Elder 14 days to commence work proposed in <br /> Monitoring Well Installation Work Plan (work plan), dated 28 June 1999, and Work Plan <br /> Addendum — August 1999 (addendum), dated 10 August 1999, both submitted by <br /> Advanced GeoEnvironmental, Inc. (AGE) and approved by this department on 07 July <br /> 1999, and 25 August 1999, respectively. Then by letter dated 15 December 1999, the <br /> EHD had directed Mr. Elder to attend a meeting on 23 December 1999 to discuss his <br /> failure to comply with the above-referenced directives. <br />
