Since that time, the EHD met with representatives of the <br /> City of Manteca, the developer (TY Lin International) and the environmental consultant (Geocon <br /> Consultants Inc.) to discuss problems caused by the withdrawal and possible solutions to enable the <br /> EHD to resume providing oversight. <br /> It was decided at the meeting that the EHD would resume oversight of the investigation and <br /> remediation of the former police firing range, but with the scope limited to the activities and goals as <br /> specified in a Remedial Action Agreement, as defined in California Health and Safety Code (CH&SC) <br /> Section 101480(c): <br /> Remedial action carried out under this section shall be carried out only pursuant to a remedial action <br /> agreement entered into by the local officer and the responsible party. The remedial action agreement <br /> shall specify the testing, monitoring, and analysis the responsible party will carry out to determine the <br /> type and extent of the contamination caused by the released waste that is the subject of the remedial <br /> action, the remedial actions that will be taken, and the cleanup goals that the local officer determines <br /> are necessary to protect human health or safety or the environment, and that, if met, constitute a <br /> permanent remedy to the release of the waste. <br /> This scope of service will keep the project within the EHD's authority and area of expertise, and will <br /> allow the resumption of local oversight. Upon successfully meeting the project cleanup goals the EHD <br /> will issue a letter that describes the release of waste that occurred and the remedial action taken, and <br /> will certify that the cleanup goals embodied in the remedial action agreement were accomplished <br /> consistent with CH&SC Section 101480(e). <br /> This letter is being sent as notification of resumption by the EHD of the Voluntary Remedial Action <br /> Agreement with the Responsible Party for the investigation and remediation of a released waste <br /> pursuant to the CH&SC, Sections 101480 and 101487. <br />
