Pursuant to Health and Safety Code (H&SC) , section <br /> 25398. 15, DTSC is required to review and approve or deny <br /> this request within 90 days of its receipt. This section <br /> also states in relevant part: <br /> . .The department shall review each request for a <br /> Certificate of Completion and shall approve the <br /> request if the department determines that the <br /> response action plan and any other directive of <br /> the department have been satisfactorily completed <br /> and that the site has been placed into a condition <br /> that allows it to be permanently used for its <br /> planned use without any significant risk to human <br /> health or potential for any future significant <br /> environmental damage. " <br /> DTSC has reviewed the City of Bakersfield's request for <br /> a Certificate of Completion at the Site, and finds that the <br /> Remedial Action Plan and other directives of DTSC have been <br /> satisfactorily implemented and the Site has been placed into <br /> a condition that allows it to be permanently used for its <br /> planned use without any significant environmental damage. <br /> The remedial action has been satisfactorily implemented and <br /> a permanent remedy to the release has been accomplished. <br /> The final response action for the Site involved the <br /> excavation and removal of soil contaminated with lead and <br /> dioxin from the front and backyards of five homes.
