AMENDED REGULATION TEXT <br /> Following, you will find an abbreviated version of Title 22, CCR, section 67450.2 noting the changes made by <br /> the March 27 emergency rulemaking submission. Deletions from existing regulation are indicated by line out <br /> (example); additions to existing regulation are indicated by underline (example . <br /> Section 67450.2 is amended as follow: <br /> "67450.2. Permit by Rule for TTUs and FTUs. <br /> (a) ... <br /> (b) ... <br /> (2) The owner or operator of a FTU that treats hazardous waste shall submit, in person or by certified mail <br /> with return receipt requested, an initial Fixed Treatment Unit Permit by Rule Facility-Specific Notification <br /> (DTSC Form 9462A (11/91)) to the Department, at the address specified in subsection (a)(1) of this section. <br /> The initial Facility-Specific Notification shall be submitted by Aptaf 1 1992 August 1. 1992 or, for persons <br /> beginning the first treatment of waste pursuant to a permit by rule after that date, a minimum of sixty (60) days <br /> prior to beginning the first treatment of waste pursuant to a permit-by-rule, whichever is later. ... <br /> (3) ... <br /> (H) A Fixed Treatment Unit Permit by Rule Unit-Specific Notification (DTSC Form 8462B (11/91)) for each <br /> FTU at the facility. The Unit-Specific Notification(s) shall be completed, dated and signed according to the <br /> requirements of section 66270.11 as those requirements apply to permit applications and shall include the FTU <br /> serial number, identification of the waste treatment process(es) to be used, the quantity of influent waste, the <br /> quantity and disposition of treatment effluents or residuals, a description of how the treatment unit operates <br /> (i.e., continuous, batch, intermittent, etc.), the hours of operation of the treatment unit, identification of <br /> whether the unit is a tank or container and the certifications specified in sections 66262.45(c), 66264.175(c), <br /> 66265.191(a) and 66265.192(x), if applicable. For the purposes of the notification required under this <br /> subsection, if the owner or operator of the FTU is unable to comnlete the certifications required by sections <br /> 66264.175(c). 66265.191(a). or 66265.192(x) before August 1. 1992 because of a need to complete physical <br /> construction then the owner or operator shall submit a schedule of compliance in writing signed according to <br /> the requirements of section 66270 11. by August 1 1992. Construction must be completed and the rmguired <br /> certifications submitted to the Department on or before February 1 1993 unless the owner or operator is <br /> ¢ranted a variance from this requirement pursuant to Health and Safety Code section 25143 on or before <br /> February 1 1993 During construction,persons treating hazardous waste in tanks must maintain compliance <br /> with section 66265.196. The schedule of compliance shall specify the following information: <br /> 1 The reasons why the owner or operator cannot comply with the certification requirements by August 1 <br /> 1992: and <br /> 2. The actions the owner or operator will take to obtain the required certifications and submit those <br /> _certifications to the Department: and <br /> 3.
