mandated DTSC to adopt emergency regulations (due February 1, 1996) to ease these <br /> requirements and reduce costs. SB 1291 also changed the onsite treatment fee system so <br /> that companiesw* <br /> 11 only pay a fee on the highest tier they operate. Previously, a separate <br /> fee was cha{ged for each tier. The fees for many onsite treatment facilities will be reduced <br /> in 1996. SB 1291 also allowed CE and CA to be authorized sooner than 60 days, upon <br /> establishing good cause. <br /> Two new laws addressed Phase I Environmental Assessment Checklists, which applies to the <br /> CA and Permit by Rule (PBR) tiers only: <br /> SB 1222 set January 1, 1997 as the Phase I due date for both CA and PBR. (Note: <br /> 1996 legislation may extend this date). <br /> AB 483 mandated that DTSC study (by July 1, 1997) whether the Phase I should be <br /> facility-wide or only regulated units. <br /> Upcoming Changes: <br /> REGULATORY STRUCTURE UPDATE: DTSC is conducting a review of the California <br /> regulatory requirements that go beyond the federal minimum standards. Many of these <br /> reviews will affect generators and onsite treaters. Topics include: review of waste <br /> classification differences, allowing extensions of the generator 90 day accumulation time, <br /> whether some onsite treatment activities are adequately regulated by other agencies, and <br /> handling wastestreams that are currently ineligible for onsite tiers (eg. cyanides and other <br /> reactive or extremely hazardous wastes). For more information, consult the Cal/EPA <br /> Bulletin Board (916) 322-5041 or Internet page call (916) 323-2561 for assistance. <br /> UNIFIED PROGRAM: SB 1082 (1993) established a new Unified Program to <br /> consolidate six programs at the local level, including hazardous waste generator and onsite <br /> treaters, hazardous material inventory and business plans, and above and underground tanks. <br /> Most local agencies applied by January 1, 1996 to become a Certified Unified Program <br /> Agency (CUPA). Within two years, most of DTSC's responsibilities to implement the <br /> generator and onsite treatment programs will be transferred to the CUPAs who will establish <br /> appropriate fees to support the Unified Program. Onsite Tiered Permitting fees will be <br /> eliminated in jurisdictions where CUPAs are certified. You will be notified as these <br /> certifications occur. <br /> New Training Class: <br /> California Compliance School celebrated its first birthday in January and is offering a new <br /> module on Tiered Permitting. The class covers finding the right tiers for your treatment <br /> activity and operating within the onsite tier requirements. Call Bakersfield College at 1-800- <br /> 337-1422 for class times, locations, cost information, and to enroll. Training on the four <br /> generator modules also is continuing, with classes available for presentation at central <br /> locations or at your worksite. <br /> -3- <br />
