September 25, 2006, DTSC received a letter from Mr. Richard Glover, Vice President of <br /> KRE Properties LLC that informed DTSC of KRE's intent to clean up the property and <br /> indicated that it intended to send Mr. Bowden back to Stockton when the owner (Mr. <br /> Shalabh Kumar) returned from overseas. <br /> 1.3.3.6. On August 8, 2008, DTSC staff made a phone inquiry to Autotech <br /> Viktron Group regarding the mailing address for Mr. Shalabh Kumar. Based on the <br /> inquiry, DTSC staff was informed that Mr. Shalabh Kumar can be contacted at the office <br /> located at 4140 Utica Ridge Road, Bettendorf, Iowa 52722. <br /> 1.4. The terms used in this Consent Agreement are as defined in California <br /> Code of Regulations, title 22, section 66260.10, except as otherwise provided. <br /> 1 .5. Respondent agrees to implement all DTSC-approved workplans and to <br /> undertake all actions required by the terms and conditions of this Consent Agreement, <br /> including any portions of this Consent Agreement incorporated by reference. <br /> 1.6. Respondent waives any right to request a hearing on this Consent <br /> Agreement pursuant to Health and Safety Code section 25187. <br /> FINDINGS OF FACT <br /> 2.1. On March 12, 1997, Viktron California submitted the Phase I Environmental <br /> Assessment Checklist pursuant to Health and Safety Code section 25200.14. <br /> 2.1.1. The Phase I Environmental Assessment Checklists identified that further <br /> Investigation was not necessary at the Facility at that time. <br /> 2.1.2. In December 2005, Respondent commenced closure of the PBR <br /> treatment units under the oversight of the San Joaquin County Environmental Health <br /> Department, Certified Unified Program Agency (CUPA). <br /> 2.1.3. On April 19, 2006, the CUPA referred the Facility to DTSC for corrective <br /> action because Respondent could not achieve clean closure. <br /> 2.1.4. On May 4, 2006, DTSC conducted an inspection at the Facility and <br /> observed corrosions, stains, waste residues, and cracks on the trenches and cement <br /> floor of the Facility. <br /> 2.1 . Based on the inspection and information available to DTSC, DTSC <br /> concludes that further investigation is needed to determine the nature and extent of any <br /> release of hazardous waste or hazardous waste constituents at the Facility. DTSC has <br /> identified the following solid waste management units (SWMUs) and/or areas of <br /> concerns (AOCs) that either have released or may release hazardous waste or <br /> hazardous waste constituents into the environment: <br /> 3 <br />
