Box 806 <br /> Sacramento, California 95812-0806 <br /> Pete Wilson Peter M.Rooney <br /> Governor November 23, 1998 Secretary for <br /> Environmental <br /> Protection <br /> TO: Interested Parties <br /> SUBJECT: SENATE BILL (SB) 21 I 1 TIERED PERMITTING EXCLUSIONS <br /> The purpose of this letter is to alert you to upcoming changes in regulatory requirements <br /> for wastes that are hazardous solely due to the presence of silver ("silver-only" hazardous <br /> wastes). Recent legislation, SB 21 1 I, mandates that, effective January I, 1999, certain "silver- <br /> only" hazardous wastes are to be regulated in California only to the extent they are regulated <br /> under the federal Resource Conservation and Recovery Act. As a result of changes mandated by <br /> SB 21 1 I, tine following onsite waste treatment activities for"silver-only" hazardous wastes will <br /> not be regulated under the Tiered Permitting program effective January 1, 1999. <br /> The recovery of silver from photofinishing/photoimaging solutions and photoimaging <br /> solution wastewaters (provided that the solutions and wastewaters are "silver-oniy" <br /> hazardous wastes, and are not hazardous for any other reason or constituent), including: <br /> Wastestreams and treatment processes #7 (under CESW) and #10 (under CA). <br /> Wastestreams and treatment processes #2 (under CESQT and PBR) where"silver- <br /> only" aqueous wastes are treated to remove silver. <br /> Please complete the enclosed Notification of"Silver-only" Hazardous Waste <br /> Treatment Form and return a copy to your local Certified Unified Program Agency, with a copy <br /> to the Department of Toxic Substances Control, if your treatment activity is eligible for regulation <br /> pursuant to SB 21 1 1 and not subject to Tiered Permitting requirements. <br /> Sincerely, <br /> ✓ L o�inula �� <br /> Paula Rasmussen, Chief <br /> State Regulatory Program Division <br /> Enclosure <br /> California Environmental Protection Agency <br /> 9 Printed on Recycled Paper <br />
