COMPLIANCE AGREEMENT Ca{��-wr• Re: Austin Road Landfill, Facility No. 39-AA-0001 Facility Inspection on August 1-2, 1990 This is in response to the violations cited by the State Solid Waste Inspectors at the Austin Road Landfill on 8/1-2/90 and how the problemswill be corrected. Enclosed are photographs depicting the problem areas. VIOLATIONS: Violation #1 (PRC 44004) : The City of Stockton's permit must be revised or modified because significant changes have occurred at our facility: it is my understanding that the City of Stockton is addressing the problem at this time and is hiring a consulting firm to help revise our current permit. The scale operator is directed to keep the daily tonnage below 512 tons per day. Violation #2 (17682): Daily Cover: We had some areas showing some exposed garbage at the end of the working day. State law stipulates that six inches of cover must be placed over the daily waste. As you know, six inches is not adequate to cover the waste to the satisfaction of any inspectors. Ten to twelve inches are presently used for daily covers. This problem has now been corrected. Please see the photographs of "before" and "after" the inspection. A meeting conducted by the L.E.A. on October 3 , 1990 indicated that they will monitor the problem on a weekly basis. Violation #3 (17684): In certain areas, the intermediate cover (twelve inches of dirt over an area which has not been used for over 180 days) was not sufficient: most of these areas are in and around the methane pipes. Evidently, Pacific Energy, which operates the Methane Recovery System for the City of Stockton borrowed dirt from the intermediate cover areas to make berms to lay their pipes on and therefore exposed some waste. There was also an area on the south side of the landfill that needed more dirt to attain the one foot layer. This item has been corrected and inspected by the L.E.A. to his satisfaction. Violation #4 (17704) : The City of Stockton is currently working with the State Water Quality Control Board on a verification monitoring and correction plan. You will be informed of the development of this correctional program. Condensate From the Methane Recovery System: The condensate system has been carefully reviewed in April, 1990 and has been approved by the Water Quality Control Board under Order No. 88-208. A copy of Pacific Energy's letter, dated October 12 , 1990, regarding the condensate system is attached for your review.
