Distance from residential structures <br /> In addition to the requirements of section 66784, no person shall <br /> establish sites for solid waste disposal without a finding by the <br /> city or county in which the site is located that the distance from <br /> the site to the nearest residential structures is in compliance <br /> with all of the state minimum standards for solid waste management, <br /> and especially that the distance of residences from the site is <br /> sufficient to permit adequate control of noise levels, odor <br /> nuisances, traffic congestion, litter nuisances and vectors. <br /> [Sec. 66784.1 Amended and Renumbered Stats 1982 ch 1468.3 <br /> Sec. 66784.3 . Fee schedule <br /> (a) Each county may, upon a majority vote of the board of <br /> supervisors, adopt a schedule of fees to be collected from each <br /> operator within its jurisdiction, including an operator who <br /> operates solely within an incorporated city. The fee shall be <br /> established in an amount sufficient to pay only those costs <br /> incurred by a county for the preparation, maintenance, and <br /> administration of the solid waste management plan required by this <br /> chapter, which are reasonable and necessary. A county may also <br /> authorize any rate adjustments necessary to carry out the <br /> provisions of this subdivision, upon a majority vote of the board <br /> of supervisors, and upon the approval by a majority of those cities <br /> within the county which contain a majority of the population of the <br /> incorporated area of the county, except in those counties which <br /> have only two cities, in which case the rate adjustments shall be <br /> approved by the city which contains a majority of the population <br /> of the incorporated area of the county. These fees shall not be <br /> used to pay any costs incurred for mediation or for the <br /> implementation of any recycling or resource recovery program. <br /> (b) A regional planning agency responsible for the preparation of <br /> a plan pursuant to Section 66780 my also adopt a schedule of fees <br /> to be collected from each operator as provided in subdivision (a) . <br /> 38 <br />
