Environmental Health Department <br />AMENDED <br />12/9/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />December 04, 2019 <br /> Facility Address: <br /> 2477 Naglee Rd, Tracy <br /> Facility Name: <br /> PetSmart #1164 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: The following observations were made with Tawnya Jeffcoat, Merchandise Inventory Leader, <br />who stated she along with the facility managers, and employee John Thorpe, handle and manage the facility's <br />hazardous waste: <br />1. An open black container, observed by the back receiving door near the hazardous waste storage area, was <br />labeled "Unsellable Items Only, ""Items To Be Destroyed," and "Only items that have been removed from inventory <br />in this bin." According to Tawnya Jeffcoat, Merchandise Inventory Leader, the items placed in this container are <br />removed and processed every day or every other day. The following waste items were observed in the container, <br />along with open packages of pet food which would be disposed of in the trash according to Tawnya: <br /> - A bottle of GNC Pets Mega Stool-No Chewable Tablets dog supplement, affixed with a receipt stating <br />"Returned Item Tag," "Reason: Not Sellable," and dated 12/2/2019. According to the PetSmart Potentially <br />Hazardous Waste Management poster in the hazardous waste storage area, vitamins and supplements are <br />classified as Toxic Hazardous Waste. <br /> - A 4 fl. oz. bottle of Tropiclean Alcohol-Free Ear Wash for pets, affixed with a piece of paper stating "used <br />RTV." Tawyna stated the ear wash was mistakingly labeled as "Return To Vendor (RTV), since she believed the ear <br />wash should be placed in a hazardous waste container. <br /> - A Free Spirit Bark Collar with Replaceable 6V Battery with "15 automatic levels of shock", affixed with a receipt <br />stating "Returned Item Tag," "Reason: Not Sellable," and dated 12/2/2019. According to the PetSmart Potentially <br />Hazardous Waste Management poster, electronic items, household and button batteries, and Lithium, Ni-Cad <br />batteries are classified as Universal Waste. <br />2. A dusty 2.5 gallon container of Pyranha Space Spray 1-10 HP Concentrate for killing and repelling insects was <br />observed in the hazardous waste area. Tawnya did not know if the container of insecticide was waste. <br />3. Two bottles of eye wash solution observed in the eye wash station, located next to the mop sink in the facility's <br />back receiving area, expired as of November 2019. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately make a hazardous waste determination for the GNC Pets Mega Stool-No <br />Chewable Tablets, Tropiclean ear wash, Free Spirit Bark Collar and battery, Pyranha Space Spray insecticide, and <br />two bottles of expired eye wash solution, manage them according to Title 22 CCR. Use Safety Data Sheets (SDS), <br />waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing <br />must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes.
