SAN JOAQUIN
Environmental Health Department
11/18/2019
Small Quantity Hazardous Waste Generator Inspection Report
Facility Name:
Facility Address:
Date:
PetSmart #1601
261 Spreckels Ave, Manteca
November 14, 2019
SUMMARY OF VIOLATIONS
(CLASS I, CLASS II, or MINOR - Notice to Comply)
Item #
Remarks
102
CCR 66262.11 Failed to determine if a waste is a hazardous waste.
OBSERVATIONS: A 2 fl. oz. bottle of Tropiclean Fresh Breath brushing gel was found in the facility's dumpster
(see photo IMG 9409-15). Marisa stated that the brushing gel might have been missed or was thought to be trash
by one of the newer employees, since toothpaste was not listed on the hazardous waste labels contents section,
nor on the PetSmart Potentially Hazardous Waste Management poster (IMG 9417). Marisa removed the bottle of
brushing gel from the dumpster, and placed it on the hazardous waste storage area shelf at the time of inspection.
REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste
as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous
wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive
or ignitable.
CORRECTIVE ACTION: Immediately stop disposal of retail chemicals as non -hazardous, make a hazardous
waste determination for each waste, and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS),
waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing
must be done using methods specified in Title 22 CCR including sections 66261.20-24.
Submit a statement and supporting documentation with your hazardous waste determination for the Tropiclean
Fresh Breath brushing gel waste. Demonstrate current storage and labeling for wastes determined to be
hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than
the number of days specified in Title 22 CCR for your hazardous waste generator status.
This is a minor violation.
104
CCR 66262.34(d)(2) No modified contingency plan.
OBSERVATION: A complete modified contingency plan was not posted at the facility.
REGULATION GUIDANCE: The business operator must post the following information next to telephones or in
areas directly involved in the generation and accumulation of hazardous waste: the name and emergency
telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and
the telephone number of the fire department unless the facility has a direct alarm.
CORRECTIVE ACTION: Immediately post the required information at the facility. A form is provided that can be
used for this purpose. Provide a statement to the San Joaquin County Environmental Health Department that the
correction is complete.
This is a minor violation.
FA0018248 PR0540514 SCO01 11/14/2019
EHD 22-01 Rev. 9/20/2019 Page 4 of 11 Small Quantity Hazardous Waste Generator OIR
1868 E.
