SAN JOAQUIN <br />Environmental Health Department <br />11/18/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />PetSmart #1601 <br />261 Spreckels Ave, Manteca <br />November 14, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />102 <br />CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: A 2 fl. oz. bottle of Tropiclean Fresh Breath brushing gel was found in the facility's dumpster <br />(see photo IMG 9409-15). Marisa stated that the brushing gel might have been missed or was thought to be trash <br />by one of the newer employees, since toothpaste was not listed on the hazardous waste labels contents section, <br />nor on the PetSmart Potentially Hazardous Waste Management poster (IMG 9417). Marisa removed the bottle of <br />brushing gel from the dumpster, and placed it on the hazardous waste storage area shelf at the time of inspection. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately stop disposal of retail chemicals as non -hazardous, make a hazardous <br />waste determination for each waste, and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), <br />waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing <br />must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination for the Tropiclean <br />Fresh Breath brushing gel waste. Demonstrate current storage and labeling for wastes determined to be <br />hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than <br />the number of days specified in Title 22 CCR for your hazardous waste generator status. <br />This is a minor violation. <br />104 <br />CCR 66262.34(d)(2) No modified contingency plan. <br />OBSERVATION: A complete modified contingency plan was not posted at the facility. <br />REGULATION GUIDANCE: The business operator must post the following information next to telephones or in <br />areas directly involved in the generation and accumulation of hazardous waste: the name and emergency <br />telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and <br />the telephone number of the fire department unless the facility has a direct alarm. <br />CORRECTIVE ACTION: Immediately post the required information at the facility. A form is provided that can be <br />used for this purpose.
