MANTECA <br />Date: <br />February 05, 2016 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR- Notice to Comply) <br />Item # <br />202 <br /> <br />Remarks <br /> <br />HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. <br />Four closed 5-gallon containers (at least one of them was visibly labeled as ProGuard Dichloro Granules) were <br />observed inside the outdoor garbage container (closed top roll off dumpster- located adjacent to the eastern property <br />boundary). Chlorine like odor was noted at the onsite solid waste container. Mr. Walker removed and opened one of <br />the 5-gallon containers labeled ProGuard Dichloco Granules from the solid waste container. This container was half <br />full with a mixture of leaves/needles, some white granules. and one white plastic lid/disc approximately 5-6 inches in <br />diameter with some accumulation of white granules. (According to the ProGuard SDS, the LC50 (toxicity to fish) for <br />this material is 0,28-2.4 mgil (96 hour exposure)). Mr. Walker returned the removed container back to the solid waste <br />container. He stated that the contents of this container were brought back from the customer's pool and that his <br />employees "bring back leaves and other stuff from people's pools" and dispose of them into the onsite garbage <br />container. Mr. Walker also indicated that only empty pool chlorine containers are thrown away and that he receives a <br />"$20" credit for his empty muriatic acid containers and as such all empty muriatic containers are "sent back to the <br />supplier for credit". Empty as well as full containers of muriatic acid were noted inside the outdoor hazardous material <br />storage area. Mr. Walker also said that "based on the MSDSs you can throw some of it out". and that he already <br />"fought it out with the Fire Department that you can throw some of it out" <br />Two 2,000-gallon above ground tanks of sodium hypochlonte solution (made i supplied by Hasa) were noted inside <br />the storage building located in the back of the property, adjacent to the norther property boundary. I asked about the <br />wet floor outside of the secondary containment for the bulk chlorine storage. Mr. Walker replied that they were filling <br />the chlorine containers earlier today and hosed down the floor afterward to clean up what was spilled. Some white <br />crystallization was also observed on the concrete floor immediately outside of the seconder/ containment. Mr. Walker <br />indicated that they don't have any spill clean-up materials onsite and any accidental spills of the liquid sodium <br />hypochlorite solution "are washed down" (rinsed down) with water. Asphalt corrosion was noted on the outside <br />driveway located next to the building where the bulk chlorine containers are stored. No drains were noted in the <br />immediate vicinity of the chemical storage areas. When I asked if the facility has any spill kits for when the 1 gallon <br />containers of muriatic acid break, Mr. Walker said that if it "breaks we run water over it and dilute <br />Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage. and <br />disposal facility (TSDF). Immediately cease disposal of hazardous waste to the ground and to the onsite garbage <br />container and ensure that all future hazardous waste is hauled by a licensed hazardous waste transporter to a <br />permitted TSDF. Submit proof of correction to the EHD <br /> <br />This is a Class I violation. <br /> <br />303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />Mr. Walker indicated that they don't have any spill clean-up materials onsite and any accidental spills of muriatic acid <br />or the liquid sodium hypochlorite solution are washed down (rinsed down) with water to the outdoor areas without any <br />rinsate containerization or disposal. All facility communications or alarm systems, fire protection equipment, spill <br />control equipment. and decontamination equipment, where required, shall be tested and maintained as necessary to <br />assure its proper operation in time of emergency. Immediately obtain all necessary spill control equipment, begin this <br />practice, submit proof of correction to the EHD. <br />This is a Class 11 violation. <br /> <br />Page 5 of 7
