Environmental Health Department Small Quantity Hazardous Waste Generator Inspection Report Date: December 05, 2019 Facility Address: 1003 HUMPHREYS DR, STOCKTON Facility Name: ONION ETC INC SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # 713 CCR 66273.35 UWH stored UW onsite greater than one year or was unable to demonstrate storage time. OBSERVATION: The facility could not demonstrate that universal waste (UW) has been stored on site for no longer than one year. The following UW was stored on-site: approximately fifty universal waste lamps including large bulbs labeled "HG" for mercury and long tubes. REGULATION GUIDANCE: (a) A universal waste handler shall accumulate universal waste for no longer than one year from the date the universal waste was generated, or was received from another universal waste handler. (b) A universal waste handler shall be able to demonstrate the length of time that the universal waste has been accumulated from the date it became a waste or was received. The universal waste handler may make this demonstration by: (1) Placing the universal waste in a container and marking or labeling the container with the earliest date that any universal waste in the container became a waste or was received; (2) Marking or labeling the individual item of universal waste (e.g., each battery or thermostat) with the date it became a waste or was received; (3) Maintaining an inventory system onsite that identifies the date the universal waste being accumulated became a waste or was received; (4) Maintaining an inventory system onsite that identifies the earliest date that any universal waste in a group of items of universal waste or a group of containers of universal waste became a waste or was received; (5) Placing the universal waste in a specific accumulation area and marking or labeling the area to identify the earliest date that any universal waste in the area became a waste or was received; or (6) Any other method which clearly demonstrates the length of time that the universal waste has been accumulated from the date it became a waste or was received. CORRECTIVE ACTION: Since it could not be demonstrated how long this UW was stored on site, immediately dispose of the UW lamps in accordance with Title 22 California Code of Regulations. Provide a corrective action statement, the disposal record and supporting documentation to the San Joaquin County Environmental Health Department (EHD) within 30 days. This is a minor violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by January 5, 2020.
