species or habitat potentially occurring in the area, the applicant will be participating in the <br /> San Joaquin Council of Governments (SJCOG) San Joaquin Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP). Participation in the SJMSCP is expected to <br /> reduce impacts to biological resources resulting from the proposed project to a level of <br /> less-than-significant and as a result, is not likely to cause any substantial environmental <br /> adverse effects. <br /> 6. The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> • This finding can be made because the drainage facilities for each lot will be built in <br /> accordance with the San Joaquin County Development Standards as required by Public <br /> Works and the domestic water well and individual sewage disposal systems will be <br /> constructed under permit and inspection by the Environmental Health Department. As a <br /> condition of approval, the Environmental Health Department is requiring a qualified <br /> environmental professional to prepare a surface and subsurface contamination report, <br /> identifying any potential source of surface or subsurface contaminations caused by past or <br /> current land uses. <br /> 7. The design of the subdivision or the types of improvements will not conflict with easements acquired <br /> by the public at large for access through or use of property within the proposed subdivision. <br /> • This finding can be made because there are no public easements within the subdivision. <br /> There is a proposed fifty (50) foot private road that shall be improved in conformance with <br /> County Standards for a 50 foot Rural Residential Road as a Condition of Approval by the <br /> Department of Public Works. Additionally, as a Condition of Approval, the developer shall <br /> prepare and record a mechanism that notices future owners and provides for maintenance <br /> of the private roadway. <br /> 8. Any land or improvements to be dedicated to the County or other public agency is consistent with the <br /> General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because there is no land to be dedicated to San Joaquin County <br /> for public roadways. Additionally,there are no applicable Specific Plans or Special Purpose <br /> Plans in the project vicinity. <br /> 9. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or <br /> cooling opportunities in the subdivision, as required by Government Code Section 66473.1 <br /> • This finding can be made because the lots are large enough so that individual dwellings can <br /> be situated to take advantage of both passive solar heating and cooling opportunities. <br /> PA-2000129— Findngs 2 <br />
