Ramsey from CAO R5-2008-XXXX (R5-2003-0713) <br /> The Prosecution Staff Report and the proposed CAO (Proposed) is rife with <br /> inaccuracies, distortions and outright misinformation. <br /> On May 2, 1992 JQCEHD found a small dispenser leak in one of the pumps <br /> on the front island. This was corrected immediately. They also requested a <br /> positive monitoring system, because of the single wall tanks, which was <br /> complied with. The station was operated in full compliance with county <br /> standards and permits. <br /> The Oil tanks were removed at my request in 1994 because they needed <br /> annual testing by being water filled, were not in use and were of no benefit. <br /> The minor amount of pollution found in the soil was removed and disposed <br /> of under county supervision. <br /> The February 1995 soils test was requested by the Bank of Stockton and had <br /> nothing to do with the county or possible UST releases. Most of the samples <br /> had no detectable level and the time or the source of the results found was <br /> not identified. No test for MTBE was done. <br /> All activities and actions from early 1996 on were with Frank Guinta as the <br /> sole owner and operator. <br /> James and Marilyn Ramsey were added to the ongoing process of the <br /> continuing clean up by Frank Guinta, at the request of Guinta's <br /> Representatives on April 30 2003 (CAO April 3 2003) according to staff. <br /> In addition staff did not contact myself or my wife concerning this matter <br /> personally, until Jan. 2006 in order to serve us with an administrative fine <br /> action for failure to act. This is after Guinta had spent 9 years (1996-2005) <br /> as the sole responsible party replacing the old tanks and cleaning up the site. <br />
