YOSEMITE AVE., MANTECA, SAN JOAQUIN <br /> COUNTY <br /> On 27 November 2006, Regional Board Staff (Jack DelConte, Brian Newman, Robert Busby, <br /> Jim Barton and legal counsel David Boyers) met with Mr. Frank Guinta and Mr. Jim Ramsey <br /> (Dischargers) to discuss Cleanup and Abatement Order No. R5-2003-0713 (Order), which was <br /> issued pursuant to Water Code Section 13304 on 18 August 2003. The other two Dischargers <br /> (Shari Guinta and Marilyn Ramsey) were not present but were informed of the meeting in <br /> advance and had stated their intention to attend the meeting. The primary purpose of the <br /> meeting was to discuss the tasks required by the Order (see attached agenda). <br /> The following presents a summary of the issues discussed and associated comments' <br /> 1) A copy of the CAO was provided to Mr. Frank Guinta and Mr. Jim Ramsey. Brian <br /> Newman clarified that as Dischargers they were required to implement all of the tasks <br /> required by the CAO. Brian reiterated that the Regional Board did NOT dismiss the <br /> CAO during the 27 October 2006 Board meeting as stated by Mr. Ramsey in his <br /> 28 October 2006 letter to the State Water Resources Control Board's Division of <br /> Financial Assistance. Both Frank Guinta and Jim Ramsey acknowledged that the CAO <br /> had not been rescinded and that they, along with Shari Guinta and Marilyn Ramsey, <br /> were still required to fully impiernent all of the tasks that have not yet been completed. <br /> We discussed the tasks in detail. Mr. Guinta stated that "I have plenty of equity in the <br /> property (at 2072 West Yosemite Avenue) to do the work" but said that he did not think <br /> it was easily available due to his contract with In Sop Kim and Myoung O Kim (Kims) <br /> who currently lease the property. He asked David Boyers if he needed to look at the <br /> contract. David Boyers replied that the status of the contract was not relevant to the <br /> discussion of compliance with the CAO. <br /> 2) Brian Newman and I explained that quarterly groundwater monitoring still needs to be <br /> conducted and that the extent of the MTBE plume has not been fully characterized. I <br /> explained how domestic well water data do not necessarily accurately depict the extent <br /> of the plume due to wells' construction and screening intervals. Frank Guinta stated <br /> that he did not think that the MTBE was necessarily coming from the site since MTBE <br /> California Environmental Protection Agency <br /> ea Recycled Paper <br />
