R03-085 (SITE ADDRESS: 2072 WEST <br /> YOSEMITE AVENUE, MANTECA, CA) <br /> I am writing in response to your letter dated October 28, 1998, which you captioned as a <br /> "Statement of Facts and Request for Information." <br /> First, let me clarify that the EAR Account is administered by the Division of Financial <br /> Assistance, a division of the State Water Resources Control Board (State Water Board). <br /> The Division of Financial Assistance is not a unit of the Central Valley Regional Water <br /> Quality Control Board (Central Valley Regional Board) and functions independently of <br /> the Central Valley Regional Board. The Central Valley Regional Board does not <br /> administer the EAR Account, but may apply to the State Water Board to receive EAR <br /> Account funds to be used for corrective action at sites that meet statutory requirements. <br /> (See Health & Saf. Code, §§ 25299.36, 25299.53, and 25299.70.) <br /> A regional board or local agency may apply for EAR Account funds to pursue corrective <br /> action at a site contaminated by petroleum from-an underground -storage-tank-(US-T)if- - - --the situation requires prompt action to protect human health or the environment or if a <br /> responsible party does not comply with a corrective action order. (Id., §§ 25299.36 and <br /> 25296.10, subd. (f).) The State Water Board is authorized to recover the amount of the <br /> EAR Account expenditures from the UST owner or operator or from any other <br /> responsible party. (ld., § 25299.70.) <br /> According to documents in EAR Account file no. R03-085, James and Marilyn Ramsey <br /> (Ramseys) owned the property at 2071 West Yosemite Avenue, Manteca (site) from <br /> 1988 to 1996. Frank and Sheri Guinta (Guintas) operated a service station at the site <br /> from 1983 to 2000. The Guintas purchased the site in 1996. In May 1992, during a site <br /> inspection, San Joaquin County Department of Environmental Health (SJCDEH) <br /> detected an unauthorized release of petroleum. The May 1992 Unauthorized Leak <br /> Report filed by SJCDEH identified Jim Ramsey as the responsible party and John <br /> California Environmental Protection Agency <br /> �a� Recycled Paper <br />
