R5-2005-0530, <br /> FRANK'S ONE STOP, 2072 W. YOSEMITEA VENUE, MANTECA, SAN JOAQUIN COUNTY <br /> Enclosed is Administrative Civil Liability Complaint (ACLC)No. R5-2005-0530 issued by the Executive <br /> Officer of the Central Valley Regional Water Quality Control Board (Regional Water Board) for violation of <br /> Cleanup and Abatement Order (CAO)No. R5-2003-0713 by Mr. James and Mrs. Marilyn Ramsey, former <br /> owners, and Mr. Frank and Mrs. Sherri Guinta, doing business as Guinta Enterprises, current owners/former <br /> operators of Frank's One Stop (jointly known as "Dischargers"). The Complaint alleges that the <br /> Dischargers violated the CAO by failing to clean up and abate the effects of the discharge, specifically to <br /> maintain and test domestic wellhead treatment systems, submit a site investigation report, a Corrective <br /> Action Plan Report, and three Quarterly Monitoring Reports. The CAO was issued on 18 August 2003 after <br /> the Dischargers depleted the UST Cleanup Fund monies allocated by the State. The Regional Water <br /> Board's UST Program Manager also issued a subsequent Notice of Violation on 16 November 2004 for <br /> failure to comply with the CAO. The Complaint proposes that the Dischargers pay $400,000 in <br /> administrative civil liability. <br /> Pursuant to the California Water Code, the Dischargers may either choose to agree to pay the civil <br /> liability and waive a Regional Water Board hearing on the matter or to proceed to a hearing before the <br /> Regional Water Board on the Complaint. If the Dischargers choose to waive the right to a hearing, then <br /> a duly authorized person must sign the waiver and remit both the waiver and a $400,000 check, made out <br /> to the State Water Resources Control Board Waste Discharge Permit Fund, to this office by <br /> 30 January 2006. The resulting settlement of this Administrative Civil Liability Complaint will not <br /> become final until after a 30-day public comment period, which began on the date of the Complaint. <br /> Additionally, the Executive Officer may decide to schedule the Complaint for a hearing consistent with <br /> California Water Code Section 13323(b). <br /> California Environmental Protection Agency <br /> �i Recycled Paper <br />
