EAR fund in allowing work that was neither practical or necessary, or scientifically linked to my
unauthorized release. I don't understand what is left to discuss as the MTBE levels are even
lower now and the city water is still available - has been for almost 4 years. Again, no I don't
want to continue spending money on unnecessary work and I believe I should be credited back
for what was unnecessary. The funds come from the EAR program now, but eventually come out
of my equity in the property.
I have tried to participate in trying to get you to identify what plan of action is really necessary
and effective. You don't appear to be willing to accept my input, didn't accept ASE's input in
2004, but readily accept the contractors' input. I don't think you have provided adequate
oversight of the contractors. They have taken advantage of you at my eventual expense. I would
hope, and ask again, that you initiate an audit of the work done by the contractors to identify
any unnecessary or ineffective work. Surely the goal of the Program can't just be to spend
money without adequate justification or benefit to the affected residents.
Sincerely,
Frank Guinta
Attachment: Letter 2004-1105 Kitay to Barton
cc: Lilly Lee, Attorney James Struck, John Russell, Diana Romero, Pearl Cross,
Jim Munch, Judy Reid, Nuel Henderson
