SAN,1 OAQU I N Environmental Health Department <br /> COUNTY— <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Office Depot#486 911 W March Ln, Stockton August 06, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: <br /> 1.Three non-empty HP black ink cartridges were observed in a container labeled"D+D"and were labeled <br /> "Damaged&Defective,"the store's back storage area.According to Jason Makinano, General Manager,these <br /> damaged ink cartridges will be sent to the Office Depot Distribution Center in Fremont, CA, in order for the store to <br /> received credit back. <br /> 2. At least five boxes each containing a broken Apple iPhone screen were observed in a box,the store's back <br /> storage area.According to Jason,the store repairs customer iPhone screens by replacing the broken screen with a <br /> new screen, and then sends the broken screens to Werx, 2380 Dean Way Ste 160, Southlake,TX. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic,corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop sending non-empty damaged ink cartridges back to the Office Depot <br /> Distribution Center and broken Apple iPhone screens to Werx, make a hazardous waste determination for each <br /> waste, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or <br /> other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br /> specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 9/5/2020. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
