S A N J O A Q U I N Environmental Health Department
JUNIY
Small Quantity Hazardous Waste Generator Inspection Report
Facility Name: Facility Address: Date:
Marshalls 0381 2429 W Kettleman Ln, Lodi August 1 2020
SUMMARY OF VIOLATIONS
(CLASS I,CLASS II,or MINOR-Notice to Comply)
Item At Remarks
105 CCR 66262.34(4)(2) No emergency coordinator.
OBSERVATION: A complete modified contingency plan with an assigned emergency coordinator was not posted at
the facility.
REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that
arise. The business operator must post the following information next to telephones or in areas directly involved in
the generation and accumulation of hazardous waste: the name and emergency telephone number of the
emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the
fire department unless the facility has a direct alarm.
CORRECTIVE ACTION: Immediately post the required information at the facility. Provide a statement to the San
Joaquin County Environmental Health Department that the correction is complete.
This is a minor violation.
106 CCR 66262.34(d)(2)Failed to train employees on waste handling and emergency procedures.
OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented)that
employees who handle hazardous waste were properly trained, based on the following observations:
1.An aerosol can of Batiste Dry Shampoo and at least three bottles of nail polish were found in a Toxics Hazardous
Waste container, although according to the hazardous waste container labels, aerosol cans and nail polish are to be
placed a Aerosols and Flammable Liquids Hazardous Waste container. Cesar Fajardo, the store manager, placed
the aerosol can and nail polish into the Aerosols and Flammable Liquids Hazardous Waste container at the time of
inspection.
2. It was unclear why a face ointment/cleanser and a hair shampoo/treatment were being stored in the Oxidizers
Hazardous Waste container, since the item labels did not reflect the guidance information on the Oxidizers
hazardous waste label. Cesar was unable to determine why these waste items were placed in the Oxidizers
Hazardous Waste container.
REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper
waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and
emergencies.
CORRECTIVE ACTION: Immediately train or re-train the employees. Provide proof of training/re-training and a
copy of the training materials within 30 days to the San Joaquin County Environmental Health Department(EHD)for
employees whose responsibilities include hazardous waste.
This is a minor violation.
FA0014477 PRO539288 SC001 08/17/2020
EHD 22-01 Rev.8/11/2020 Page 5 of 9 Small Quantity Hazardous Waste Generator OR
1868 E.
