Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />August 12, 2019 <br /> Facility Address: <br /> 23456 E FLOOD RD, LINDEN <br /> Facility Name: <br /> LONE TREE CREEK VINEYARDS-LINDEN HILLS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br />An accumulation of oil was observed in the secondary containment of the portable used oil storage tank.. Dark <br />staining was observed under the Red Diesel aboveground storage tank. Staff indicated there may be a leak. Facilities <br />shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, <br />soil, or surface water which could threaten human health or the environment. Immediately remove the accumulation <br />of oil, fix the diesel leak, and clean up stained soil, and manage according to Title 22 hazardous waste regulations. <br />Submit a statement and supporting documentation explaining how this waste was managed. <br />This is a minor violation. <br /> 406 CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br />Several 55 gallon drums were observed on site neat the fuel tanks. Containers larger than five gallons that previously <br />held a hazardous material shall be marked with the date they were emptied and managed within one year of being <br />emptied. Immediately mark and manage all empty containers per this section. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by September 12, 2019. <br />Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152). To schedule an <br />appointment, please call (209) 468-3420. <br />Notes: The emergency contingency plan submittal on CERS has emergency coordinator information, but a modified <br />contingency plan was filled out on site and posted in the employee notification area of the shop. <br />The following violation was observed and is noted here because it is a first time violation and has been corrected <br />on site. <br />The portable used oil storage tank was observed without a hazardous waste label. All hazardous waste containers <br />shall be marked with the following information: <br /> - the words “Hazardous Waste” <br /> - name and address of generator <br /> - hazardous properties <br /> - physical state <br /> - composition (contents) <br /> - accumulation start date <br />Immediately label these containers and ensure that all containers are marked with all the required information. <br />Since these containers have been on site longer than 180 days, immediately contact a licensed hazardous waste <br />hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD.
