Missouri Ave., Suite 400 <br /> Phoenix, AZ 85012 <br /> Re: CSK Auto Store No. 4025, Tracy, California <br /> Dear Ms. Morrison: <br /> We represent the Robert and Louise Schwab Family Trust ("the Schwab Trust"), owner <br /> of the property located at 1210 Tracy Boulevard in Tracy, California ("the Tracy Property"), <br /> which is currently occupied by CSK Auto store no. 4025. On March 9, 2001, the Schwab Trust <br /> learned for the first time that this property may have become contaminated by a petroleum <br /> product release. We are extremely concerned about this situation, and we wish to ensure that <br /> CSK Auto properly investigates and fully remediates the situation as quickly as possible. <br /> As you know, CSK Auto leases the Tracy Property under the terms of a Sublease from <br /> Safeway Stores, Inc., dated December 7, 1987, and a Master Lease from the Mutual Life <br /> Insurance Company of New York dated November 24, 1959, and modified on July 7, 1969. The <br /> Schwab Trust does not occupy any portion of the Tracy Property itself. As a consequence of <br /> several transactions, CSK Auto is now responsible for fulfilling obligations to the Schwab Trust <br /> under both the Sublease and the Master Lease.
