1.3 PUBLIC PARTICIPATION <br /> Effective October 14, 2001, Assembly Bill (AB) 972 amended the California Education Code (CEC) <br /> Sections 17210.1 and 17213.1. Following changes in the code identified in AB 2644, AB 972 further <br /> refines the environmental review process for the proposed acquisition and construction of school <br /> properties where state funding is utilized. In conjunction with AB 387 and Senate Bill 162, AB 2644 <br /> made significant changes in the public review and approval process for PEAS. Significant changes to <br /> these public participation requirements stated in AB 972 for school districts during PEAs include the <br /> following: (1) providing a notice to residents in the immediate area, utilizing a format developed by <br /> DTSC, prior to initiating the field work; (2) scheduling a public review and comment period under two <br /> options, one separate from the process under the California Environmental Quality Act (CEQA) for <br /> public hearings and one in combination with the CEQA process public hearing. As per the project scope <br /> of work,the public participation activities will be performed by LUSD. <br /> In compliance with AB 972, the LUSD will send a PEA notification letter, in a form approved by DTSC, <br /> to the immediate residents prior to any field sampling activities. A PEA report will be prepared to <br /> document all sampling activities and present chemical data. These PEA findings will be made available <br /> to the public through establishment of document repositories at convenient locations, distribution of fact <br /> sheets,and public meetings including workshops. <br /> Upon DTSC's approval of the PEA report for public review and comment, and if the LUSD has chosen to <br /> proceed with the school construction project, the LUSD will hold a public comment period and a public <br /> hearing either separately or in conjunction with the CEQA process. Following the end of the public <br /> comment period, the LUSD will forward all comments on the PEA report to DTSC, which will provide <br /> them to URS. If necessary, URS will revise the PEA Report to address the public comments. URS will <br /> then submit the final PEA Report to DTSC, which will make a final PEA determination accordingly. <br /> 1.4 DATA COLLECTION AND EVALUATION <br /> A sampling and analysis program will be conducted to evaluate the potential presence of chemical <br /> constituents in soil gas, surface soils, and subsurface soils. The following sampling plan is based on the <br /> scope of work provided by the DTSC. USEPA-approved methods will be used for sampling and analysis, <br /> wherever possible. The Site sampling and analytical program is fully described in Section 4.0. The <br /> following presents an overview of the sampling program rationale. Figure 3 shows the proposed <br /> sampling locations. Figure 4 presents the preliminary conceptual site model. <br /> As set forth in the DTSC work order, the potential presence of volatile organic compounds (VOCs) will <br /> be evaluated based on a soil gas survey that will be conducted in accordance with the current DTSC <br /> Advisory - Active Soil Gas Investigations [DTSC, 20031 that incorporates the Regional Water Quality <br /> Control Board, Los Angeles Region (LARWQCB) Interim Guidance for Active Soil Gas Investigation <br /> (ASGI)protocols [LARWQCB, 1997]. <br /> Soil gas samples will be collected from 21 locations at 5 feet below the ground surface (bgs), and from 6 <br /> of the same locations at 15 feet bgs. As specified in the scope of work provided by DTSC, six, six, and <br /> three of the soil gas sample locations will be in the southern, northern, and western parcels, respectively, <br /> and six additional locations will be in specific areas of concern. Based on the results of the soil gas <br /> samples at 15 feet bgs, and in consultation with the DTSC, additional soil gas samples may be collected at <br /> 25 feet and/or at 35 feet bgs. Soil gas samples will be analyzed for target VOCs, including benzene, <br /> toluene, ethylbenzene, and xylenes (collectively, BTEX), specified in Section 3.1 of the LARWQCB <br /> guidance using modified EPA method 8260B.
