Turner Road
Lodi, CA 95242
NOTICE OF VIOLATION, INCOMPLETE REPORT, WORKPLAN FOR MONITORING WELL
INSTALLATION, SAMPLING AND ANALYSIS, JESSIE'S GROVE WINERY, SAN JOAQUIN
COUNTY
Staff has reviewed the 10 March 2005 Workplan for Monitoring Well Installation, Sampling, and
Analysis at Jessie's Grove Winery(Workplan) prepared by Neil O. Anderson and Associates (NOA) and
determined it is incomplete. The report is a revision of the 4 February 2005 Workplan for Monitoring
Well Installation, prepared by NOA; staff provided comments on the 4 February 2005 workplan in a
16 February 2005 Conditional Approval letter. A copy of the 16 February 2005 letter is attached.
The 10 March 2005 Workplan failed to address the items listed in the Regional Board's 16 February
2005 Conditional Approval letter and therefore they are restated herein. It should also be noted that
Jessie's Grove is significantly behind the schedule presented in the 2 December 2004 Notice of
Violation, Failure to Submit Technical and Monitoring Reports. That letter stated the following:
Due to the failure to submit the required reports pursuant to Section 13267 of the California
Water Code, staff's usual next step is to recommend to management that civil liability (i.e.,
monetary penalties) be assessed against the Discharger. As of I December 2004, the maximum
liability for the delinquent reports listed above is $452,000.
However, staff will not recommend that the Executive Officer issue an Administrative Civil
Liability Complaint if the delinquent reports are submitted no later than I March 2005. Note
that the reports must contain all the information described in the Provisions section of the
WDRs. They must also be completed by a registered professional, as described in the WDRs. In
addition, the monitoring reports must be submitted monthly, beginning with the December 2004
monitoring report, which is due by I February 2005.
Continued failure to submit complete technical reports may result in enforcement activity including
imposition of Administrative Civil Liabilities (fines). By 6 May 2005, Spenker Ranch, Inc. and Jessie's
Grove Winery shall submit an addendum report that addresses the following issues:
California Environmental Protection Agency
0 Recycled Paper
