SAN, J DA Q U I N Environmental Health Department <br /> COUNTY-- Linda Turkatte, REHS, Director <br /> Kasey Foley,REHS,Assistant Director <br /> PROGRAM COORDINATORS <br /> Robert McCIdlon,REHS <br /> Jeff Carruesco,REHS,RDI <br /> Willy Ng,REHS <br /> Muniappa Naidu,REHS <br /> Michael Kith,REHS <br /> August 2, 2018 <br /> RAFAEL GONZALEZ <br /> 11500 W CLOVER ROAD <br /> TRACY, CA 95304 <br /> NOTICE TO ABATE IMMEDIATELY <br /> RE: Contaminated Soil disposal: 18373 S MacArthur Blvd,Tracy Complaint No. C00047038 <br /> The San Joaquin County Environmental Health Department (EHD) has received a complaint alleging that <br /> excavated contaminated waste soil generated from several cleanup sites in the Bay Area are being disposed of <br /> on your property. <br /> NATURE OF COMPLAINT: Complaint received alleges"Old River Golf Course brought in loads of dirt for grading, <br /> soil contaminated, brought from Bay Area from old gas station properties. Property owner planning to bring in <br /> several mini homes and are starting construction on vacant strip of land that runs along golf course." <br /> OBSERVATIONS:An investigation by the EHD has verified that contaminated waste soil is being disposed <br /> of on the above noted property.This location is not a disposal facility permitted to accept waste,including <br /> contaminated waste soil. <br /> VIOLATION: The following violations apply: <br /> 1. San Joaquin County Ordinance 9-1125.4: It shall be unlawful for any person to discharge any treated or <br /> untreated wastes that may be detrimental to the surface or ground waters of the County. Wastewater <br /> discharges shall meet the discharge standards set by the State Regional Water Quality Control Board <br /> (RWQCB) and the requirements contained in this Chapter. <br /> 2. California Code of Regulation Section 66262.11: Failed to determine if a waste is hazardous waste. <br /> 3. San Joaquin County Ordinance 5-2600: No person shall operate a disposal area in the County unless <br /> such person first shall have obtained a disposal area permit issued by the Health District. <br /> 4. Health and Safety Code 5411: No person shall discharge sewage or other waste, or the effluent of treated <br /> sewage or other waste, in any manner which will result in contamination, pollution or a nuisance. <br /> 5. Water Code 13260: Failed to file a report of waste discharge with the Regional Board. <br /> CORRECTIVE ACTION: Effective immediately, cease the disposal of the contaminated soil on your <br /> property and remove all soil disposed of on the property to an appropriately permitted waste disposal <br /> facility.
