Provide a corrective action statement to the San Joaquin County Environmental Health Department <br /> within 30 days. <br /> This is a Class II violation. <br /> 201 HSC 25163(a)Transported or transferred hazardous waste to a transporter without valid registration. <br /> OBSERVATION: This business transported or transferred hazardous waste to a transporter without valid <br /> hazardous waste transporter registration. The hazardous waste consisted of used oil, used oil filters, used coolant <br /> and was transported from 2016 to 2018.The transporter could not provide valid hazardous waste transporter <br /> registration or manifest records during the inspection. <br /> Note: Operator states that all hazardous waste stored on site have been stored for longer than 180 days. He could <br /> not provide any manifest, he states that a 3rd party,that his brother-in-law knew has taken his used oil and used <br /> metal oil filters in the past. Inspector asked if he knew the 3rd party or if they left any manifest. He states that he <br /> does not know the 3rd party or recalls if they ever left a manifest/disposal receipt. <br /> VIOLATION GUIDANCE: <br /> Except as otherwise provided, it is unlawful for any person to carry on, or engage in,the transportation of hazardous <br /> wastes unless the person holds a valid registration issued by the department, and it is unlawful for any person to <br /> transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by the <br /> department.A person who holds a valid registration issued by the department pursuant to this section is a <br /> registered hazardous waste transporter for purposes of this chapter.Any registration issued by the department to a <br /> transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. <br /> Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in <br /> his or her possession while transporting the hazardous waste.The registration certificate shall be shown upon <br /> demand to any representative of the department, officer of the Department of the California Highway Patrol, any <br /> local health officer, or any public officer designated by the department. <br /> CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without <br /> valid hazardous waste registration.
