OBSERVATION: This business's hazardous waste activities have not been reported on the California Electronic Reporting System (CERS)website. REGULATION GUIDANCE: Each regulated business shall report program data electronically on the CERS website. CORRECTIVE ACTION: Immediately report your business activities including the hazardous waste program on the CERS website. Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation. 201 HSC 25163(a)Transported or transferred hazardous waste to a transporter without valid registration. OBSERVATION: This business transported or transferred hazardous waste to a transporter without valid hazardous waste transporter registration. The hazardous waste consisted of used oil, used oil filters, used coolant and was transported from 2016 to 2018.The transporter could not provide valid hazardous waste transporter registration or manifest records during the inspection. Note: Operator states that all hazardous waste stored on site have been stored for longer than 180 days. He could not provide any manifest, he states that a 3rd party,that his brother-in-law knew has taken his used oil and used metal oil filters in the past. Inspector asked if he knew the 3rd party or if they left any manifest. He states that he does not know the 3rd party or recalls if they ever left a manifest/disposal receipt. VIOLATION GUIDANCE: Except as otherwise provided, it is unlawful for any person to carry on, or engage in,the transportation of hazardous wastes unless the person holds a valid registration issued by the department, and it is unlawful for any person to transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by the department.A person who holds a valid registration issued by the department pursuant to this section is a registered hazardous waste transporter for purposes of this chapter.Any registration issued by the department to a transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in his or her possession while transporting the hazardous waste.The registration certificate shall be shown upon demand to any representative of the department, officer of the Department of the California Highway Patrol, any local health officer, or any public officer designated by the department. CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without valid hazardous waste registration. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department within 30 days. This is a Class I violation.
