<br /> 5 Amended Complaint in this action nor the Stipulation and Judgment, shall constitute notice or
<br /> 6 discovery by any governmental entity of any suspected or actual environmental harm, including,
<br /> 7 but not limited to, a release, spill, leak, emission,escape, leach, disposal, or discharge at or from
<br /> 8 any of the Covered Facilities, for purposes of the statute of limitations of claims.

<br /> 10 I. GENERAL INJUNCTIVE PROVISIONS
<br /> 11 8. Pursuant to California Health and Safety Code sections 25299.01 and 25299.04, as of
<br /> 12 the date of entry of the Judgment by this Court:
<br /> 13 (a) Defendants are each enjoined from failing or refusing to comply with the provisions of
<br /> 14 California Health and Safety Code, division 20, chapter 6.7, and California Code of Regulations,

<br /> 15 title 23, section 2610 et seq. (UST Laws), as existing on the date of entry of the Judgment by this
<br /> 16 Court, and as amended in the future, relating to the installation, operation,maintenance,
<br /> 17 modification, repair, or closure of underground storage tanks (USTs) or underground storage tank
<br /> 18 systems at the Covered Facilities or newly acquired UST facilities, and all relevant State, county,
<br /> 19 city, district, and CUPA regulations, ordinances, permits, and orders based on those statutes and
<br /> 20 regulations.
<br /> 21 (b) Defendants are each required to comply with the provisions of California Health and
<br /> 22 Safety Code, division 20, chapter 6.7, and California Code of Regulations, title 23, section 2610
<br /> 23 et seq., cited as violations at the Covered Facilities on Exhibit B.
<br /> 24 (c) Defendants are each required to comply with the provisions of Health and Safety Code
<br /> 25 sections 25290.1, subdivision (h), 25290.2, subdivision (g), 25291, subdivision(f), and 25292,
<br /> 26 subdivision (e)(1), and Title 23, California Code of Regulations, sections 2636, subdivisions (f)(2)
<br /> 27 and 2643(c)(1) (install and/or maintain automatic line leak detectors on underground pressurized
<br /> 28 piping that conveys a hazardous substance).
