In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> On 10/25/2019, Stacy Rivera of the San Joaquin County Environmental Health Department (EHD) performed a routine undergroun <br /> storage tank inspection at the above referenced site. The site was found to be out of compliance. The violations include but are no <br /> limited to the following: <br /> -According to Manish Pahwa, Mr Karan Pahwa has been the new owner at the above facility since 3/20/2019. A permit to operate th <br /> UST system has not been issued. No person may own or operate an UST unless a permit for its operation has been issued by the loca <br /> agency to the owner or operator of the UST system. (HSC 25284) <br /> -Any person assuming ownership of an UST used for the storage of hazardous substance for which a valid operating permit has been <br /> issued shall have 30 days from the date of assumption of ownership to the owner or operator of the tank. (HSC 25284) <br /> -No CERS submittal has been made for the new owner. Permits may be transferred to a new underground storage tank owner if <br /> complete submittal is made to the California Environmental Reporting System within 30 days of the change in ownership. (CCR 2712) <br /> -The mechanical flapper used as the overfill prevention system on the diesel UST was listed as a failure on the 1/11/19 overfil <br /> prevention equipment inspection and is not currently functional.All UST systems must be equipped with an approved,functional overfil <br /> prevention device at all times during delivery operations.
