In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On 10/25/2019, Stacy Rivera of the San Joaquin County Environmental Health Department (EHD) performed a routine undergroun storage tank inspection at the above referenced site. The site was found to be out of compliance. The violations include but are no limited to the following: -According to Manish Pahwa, Mr Karan Pahwa has been the new owner at the above facility since 3/20/2019. A permit to operate th UST system has not been issued. No person may own or operate an UST unless a permit for its operation has been issued by the loca agency to the owner or operator of the UST system. (HSC 25284) -Any person assuming ownership of an UST used for the storage of hazardous substance for which a valid operating permit has been issued shall have 30 days from the date of assumption of ownership to the owner or operator of the tank. (HSC 25284) -No CERS submittal has been made for the new owner. Permits may be transferred to a new underground storage tank owner if complete submittal is made to the California Environmental Reporting System within 30 days of the change in ownership. (CCR 2712) -The mechanical flapper used as the overfill prevention system on the diesel UST was listed as a failure on the 1/11/19 overfil prevention equipment inspection and is not currently functional.All UST systems must be equipped with an approved,functional overfil prevention device at all times during delivery operations. (CCR 2635) The site must be brought into compliance to avoid the entire UST system being red tagged 7-days from the receipt of this Notice.
