Product Product Tanks Red Tagged : Level : ' � � Level : Level : Red TagRed Tag Red Tag ID #: ID #: ID #: Type of significant violation : 0 A violation that is causing , or threatens to cause a liquid release of petroleum from an underground storage tank system , including , but not limited to : the failure of any required overfill prevention system , where the failure is causing or threatens to cause a release ; or the failure of a required spill containment structure , where the failure is causing or threatens to cause a release to the environment due to a spill or an overfill . ❑ A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law . ❑ A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action ) . On 10/25/2019 , Stacy Rivera of the San Joaquin County Environmental Health Department ( EHD) performed a routine undergroun storage tank inspection at the above referenced site. The site was found to be out of compliance . The violations include but are no limited to the following : -An incomplete CERS submittal has been made for the new owner. Permits may be transferred to a new underground storage tan owner if a complete submittal is made to the California Environmental Reporting System within 30 days of the change in ownership. (CCR 2712) -The mechanical flapper used as the overfill prevention system on the diesel UST was listed as a failure on the 1 /11 /19 overfil prevention equipment inspection and is not currently functional . All UST systems must be equipped with an approved , functional overfil prevention device at all times during delivery operations.
