I doing business in the State of California and confined to Defendant's GAS STATION/FOOD MART 2 activities in the County of San Joaquin and elsewhere in the State of California. 3 3. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they 4 are doing business in the State of California,in the course of Defendant's GAS STATION/FOOD 5 MART activities, are pursuant to Health and Safety Code section 25181 hereby perinanently 6 enjoined from: 7 a. Treating, storing, disposing of,transporting or offeruig to transport hazardous 8 waste without having an Identification Number, in violation of California Code of Regulations,title 9 22 section 66262.12(a); and 10 b. Failing to label or mark containers used for onsite accumulation of hazardous 11 waste, i1 violation of California Code of Regulations,title 22, section 66262.34(f). 12 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they 13 are doing business in the State of California, in the course of Defendant's GAS STATION/FOOD 14 MART activities, are pursuant to Health and Safety Code section 25299.1 are permanently enjoined 15 fiom: 16 a. Failing to annually test the spill containment structure, in violation of Health and 17 Safety Code section 25284.2; 18 b. Failing to obtain permit to operate underground storage tank, in violation of Health 19 and Safety Code section 25286(a); 20 c. Failing to prevent structural weakening of secondary containment, in violation of 21 Health and Safety Code section 25291(a)(2); 22 d. Failing to design and construct an underground storage tank system with a 23 monitoring system capable of detecting the entry of the hazardous substance stored in the primary 24 containment into the secondary containment, in violation of Health and Safety Code section 25 25291(b); 26 e. Failing to maintain monitoring system of water intrusion and for removing the 27 water, in violation of Health and Safety Code section 25291(e); 28 f. Failing to annually perform automatic line leak detector tightness test, in violation -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
