I p. Failing to provide training by a designated underground storage tank operator for <br /> 2 facility employees on the proper operation and maintenance of the underground storage tank system <br /> 3 once every twelve (12)months, in violation of California Code of Regulations,title 23, section <br /> 4 2715(f). <br /> 5 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 6 are doing business in the State of California,in the course of Defendant's GAS STATIONNOOD <br /> 7 MART activities, are pursuant to California Business and Professions Code, section 17204 hereby <br /> 8 permanently enjoined from: <br /> 9 a. Violating Health and Safety Code section 25100 et seq., described in paragraph <br /> 10 3 —3b above; <br /> 11 b. Violating Health and Safety Code section 25280 et seq., described in paragraph <br /> 12 4—4p above. <br /> 13 6. Defendant shall pay to Plaintiff the sum of FOUR THOUSAND DOLLARS ($4,000.00), <br /> 14 as and for civil penalties, pursuant to Health and Safety Code §25299. Said payment shall be made <br /> 15 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DISTRICT— <br /> 16 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br /> 17 Joaquin County Office of the District Attorney, Enviromnental Prosecutions Unit, as follows: <br /> 18 a. $2,000.00 on or before March 14, 2012 <br /> 19 b. $2,000.00 on or before March 14, 2013 <br /> 20 7. Defendant shall pay to the Plaintiff the sum of FOUR THOUSAND DOLLARS <br /> 21 ($4,000.00), as and for civil penalties,pursuant to Business and Professions Code section 17206.. <br /> 22 Said payments shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and <br /> 23 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> 24 Unit, as follows: <br /> 25 a. $2,000.00 on or before March 14, 2012 <br /> 26 b. $2,000.00 on or before March 14, 2013 <br /> 27 8. Defendant shall be penalized, as for civil penalties,pursuant to Business and Professions <br /> 28 Code sections 17200 et seq., in addition to penalties set forth in paragraphs 6 and 7, TWENTY FIVE <br /> -4— <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
