(3) each container and tank used for onsite accumulation of hazardous waste shall be labeled <br />or marked clearly with the words, "Hazardous Waste." Additionally, all containers and <br />portable tanks shall be labeled with the following information: <br />(A) composition and physical state of the wastes; <br />(B) statement or statements which call attention to the particular hazardous properties of <br />the waste (e.g., flammable, reactive, etc.); <br />(C) name and address of the person producing the waste. <br />4 Two hazardous waste containers were not labeled on September 16, 2003 and a 55 - <br />gallon hazardous waste drum was found without an accumulation start date on <br />September 20, 2007 at the Tracy facility. <br />HSC 25160(b)(3) failed to submit TSDF manifest to the department for Out -of -State <br />shipments. Within 30 days from the date of transport, or submission for transport, of <br />hazardous waste out of state, each generator of that hazardous waste shall submit to the <br />department a legible copy of each manifest used. The copy submitted to the department shall <br />contain the signatures of the generator, all transporters, excepting intermediate rail <br />transporters, and the out-of-state facility operator. If within 35 days from the date of the initial <br />shipment, or for exports by water to foreign countries 60 days after the initial shipment, the <br />generator has not received a copy of the manifest signed by all transporters and the facility <br />operator, the generator shall contact the owner or operator of the designated facility to <br />determine the status of the hazardous waste and to request that the owner or operator <br />immediately provide a signed copy of the manifest to the generator. Except as provided <br />otherwise in paragraph (2) of subdivision (h) of Section 25123.3, if within 45 days from the <br />date of the initial shipment or, for exports by water to foreign countries, 90 days from the date <br />of the initial shipment, the generator has not received a copy of the signed manifest from the <br />facility owner or operator, the generator shall submit an exception report to the department. <br />--> Two Texas manifests were found at the Tracy facility on September 20, 2007 not <br />shipped to DTSC within 30 days. <br />Title 22, CCR 66262.23(a)(4) Generator manifest copies not sent to the department <br />within 30 days. The generator of any hazardous or extremely hazardous waste to be <br />transported off-site or into California shall within 30 days of each shipment of hazardous <br />waste submit to the Department a legible copy of each manifest used. <br />4 A blue generator copy of manifest #23695030 from 2005 was found at the Tracy <br />facility on September 20, 2007. <br />Title 22, CCR 66262.34(d)(2) Modified emergency coordinator information lacking or <br />insufficient [as referenced by CFR 262.34(d) and CFR(e)&(f)].
