Olivera Food, Inc.,952 W. Bowman.Road, French Camp, CA
Dear Mr_Muller:
Thank you for meeting with Environmental Health Department (EHD) staff and me on May 23,
2006, to discuss your concerns regarding the Olivera Food, Inc., poultry egg facility located at.
952 W. Bowman Road, French Camp. As a follow-up to our meeting and in response to the.
questions in your May 22, 2006, letter provided that date, the following information is provided:
1. How long are you going to.let it continue in its present condition?
Robert McClellon, Supervising RES, and Community Development Department
representatives, Rick Matuska and Juanita Huerta,. conducted a complaint inspection at the
Olivera Food, Inc. poultry egg facility on Bowman Road on May 24, 2006, with facility
operators. Richard and Jerry Jenkins. Issues concerning manure management, vector
control, solid waste disposal and poultry house issues were identified during the.inspection. .
The first follow-up inspection will be conducted on June 7, 2006..
2. If it is closed down.for.not being in.compliance who is responsible for the clean up?.
In general, if a business closes, the owner of the property is responsible for any clean up
necessary. Ultimately,if compliance.cannot be.achieved at a business or operation that has
County regulatory oversight, and all other enforcement means have been exhausted, a
referral is made to the District Attorney's Office for legal action.
3. If it is sold, who is responsible for clean up of the contaminated soil and decaying
buildings?
The owner of the property is responsible for any clean up,repair or demolition issues..
. Is there a way to put a restriction on the sale of the property to be sure we, as
taxpayers will not be responsible fort the clean.up?
Any property transfer would be subject to applicable real estate disclosure laws and
regulations.
