Bowman.Road, French Camp, CA <br /> Dear Mr_Muller: <br /> Thank you for meeting with Environmental Health Department (EHD) staff and me on May 23, <br /> 2006, to discuss your concerns regarding the Olivera Food, Inc., poultry egg facility located at. <br /> 952 W. Bowman Road, French Camp. As a follow-up to our meeting and in response to the. <br /> questions in your May 22, 2006, letter provided that date, the following information is provided: <br /> 1. How long are you going to.let it continue in its present condition? <br /> Robert McClellon, Supervising RES, and Community Development Department <br /> representatives, Rick Matuska and Juanita Huerta,. conducted a complaint inspection at the <br /> Olivera Food, Inc. poultry egg facility on Bowman Road on May 24, 2006, with facility <br /> operators. Richard and Jerry Jenkins. Issues concerning manure management, vector <br /> control,solid waste disposal and poultry house issues were identified during the.inspection. . <br /> The first follow-up inspection will be conducted on June 7, 2006.. <br /> 2. If it is closed down.for.not being in.compliance who is responsible for the clean up?. <br /> In general, if a business closes, the owner of the property is responsible for any clean up <br /> necessary. Ultimately,if compliance.cannot be.achieved at a business or operation that has <br /> County regulatory oversight, and all other enforcement means have been exhausted, a <br /> referral is made to the District Attorney's Office for legal action. <br /> 3. If it is sold, who is responsible for clean up of the contaminated soil and decaying <br /> buildings? <br /> The owner of the property is responsible for any clean up,repair or demolition issues.. <br /> . Is there a way to put a restriction on the sale of the property to be sure we, as <br /> taxpayers will not be responsible fort the clean.up? <br /> Any property transfer would be subject to applicable real estate disclosure laws and <br /> regulations. <br />
