Subject: Olivera Food, Inc., 952 W..Bowman.Road, French.Camp, CA Dear Ms..Reynolds: Thank you for meeting with Environmental Health Department (EHD). staff and me on May 23, 2006, to discuss. concerns. regarding the Olivera Food, Inc., poultry egg facility located at 952. Bowman Road, French Camp.. The following information is.provided in response to. your letter dated May 24, 2006, concerning EHD requirements. for a manure management plan at this operation. Your.questions.are listed below with the corresponding responses. 1. "Was.your department's.request to r. Olivera made in.writing? The EHD request for Mr. Olivera to submit 'a manure management plan involved a discussion with Mr. Olivera during an inspection on April 7, 2006, when he indicated that he, was. considering a change in the facility manure management practices. Mr.. Olivera was proposing to.dry pad the manure.in one of the ponds.located on site(afterr the pond had dried up). Robert McClellon, Supervising RES, explained to. Mr. Olivera that the. EHD. would require submittal of a manure management plan for review and approval prior to. changing current manure handling practices. . After this, inspection, the. EHD Manure/Solid Waste Management Plan Guidance Document was.faxed to.Mr..Olivera... 2. "Was.Mr..Olivera Given.a deadline for submitting the.Plan?" As. stated above,. submittal of a manure management plan would have been required prior to. implementation of any proposed changes in the manure handling procedures at the site. . During a subsequent inspection on May 24, 2006, Mr.. Olivera was. directed in the. EHD. Inspection Report to.submit a manure management plan by June 24, 2006. 3. "What follow- p. contact was. made with Mr. Olivera, asking for his. compliance? Was. the follow- p.in.writing or by telephone?" Prior to the. May 24, 2006 inspection, Mr..McClellon had telephone contact with Mr. Olivera to discuss potential changes to the manure handling practices at the Bowman Road site, but a plan had not yet been submitted.. . Mr.. Olivera was. directed in the ED. Inspection Report dated May 24,.2006, to submit a manure management plan by June 24, 2006.
