i The following is an itemized list of hazardous waste violations that have not been addressed for LATHROP WATER TREATMENT FACILITY/CORP YARD as of September 22, 2016. Open violations from May 10, 2016 inspection Violation#107-Failed to prepare and implement a contingency plan. At time of inspection: It was seen where the batch tank had overflowed releasing hazardous waste, filter press sludge, to the ground. The hazardous waste appeared to flow North towards a storm drain. As we walked towards the spill area we, Robert i Lopez and myself, were told the release was contained to that area and had not impacted the on site storm drain, which leads to the on site retention pond. Upon further investigation it was determined the hazardous waste had made it into the storm drain and into the on site retention pond. According to the contingency plan, "The Lathrop/Manteca Fire District prepared a response plan which considers the chemicals stored on site. The specific chemicals considered are Diesel Fuel, Ferric Chloride, and Chlorine." The Lathrop/Manteca Fire District did not respond to this release. There was no clean-up done for this release because the facility was waiting until the water dried out, making it easier to clean-up. It is not known how much of the hazardous waste was released to the ground, into the storm drain and into the retention pond. Immediately begin to implement a contingency plan that has been designed to minimize hazards to human health or the environment from fires, explosions, or any unplanned or non-sudden of hazardous waste or hazardous waste constituents to air, soil or surface water specific to this facility, its operations, and the types of hazardous waste stored on site. Violation #108 - Contingency plan is incomplete. The facility's contingency plan is incomplete. The contingency plan is lacking an emergency coordinator. The plan also states"The Lathrop/Manteca Fire District prepared a response plan which considers the chemicals stored on site. The specific chemicals considered are Diesel Fuel, Ferric Chloride, and Chlorine." It was not clear what this statement means or how it is being applied, The contingency plan must include: 1. Description of actions facility personnel wil(take in response to fires, explosions, or any sudden or non-sudden release of hazardous waste to air, soil or surface water at the facility; 2. Description of arrangements made with local police departments, fire departments, hospitals, contractors and State and local emergency response teams to coordinate emergency services; 3. List of names, addresses, and phone numbers (office/home/cell)of all persons qualified to act as emergency coordinator. Where more than one person is listed, one shall be named as the primary emergency coordinator and all others in order in which they will assume responsibilities; 4. List all emergency equipment, which includes location, physical description, and brief outline of its capabilities; 5. Evacuation routes for facility personnel where there is a possibility of evacuation; 6. Current telephone number for State Office of Emergency Services. If the facility has a Spill Prevention, Control and Countermeasures plan, or some other emergency or contingency plan, the owner or operator need only amend that plan to incorporate hazardous waste management provisions that are sufficient to comply with the requirements of this chapter. Immediately prepare or amend an existing plan to fulfill the requirements of this chapter. Submit a copy of the contingency plan to the EHD. i Violation#109 - Failed to maintain a hazardous waste contingency plan onsite and submit to required agencies. The contingency plan was not available at the time of inspection. A copy of the contingency plan and all revisions to the pian shall be maintained at the facility at all times. Immediately locate a copy of the contingency plan, update it, for the facility and submit copies of the plan to the EHD and to all other agencies that may be called upon to provide emergency services.
