Operator stated that he <br />acquired the containers when he inherited the shop from previous owner. <br />-One 55 -gallon container filled with unknown contents located near south side of shop. Operator stated that he <br />acquired the container when he inherited the shop from previous owner. <br />-Used paint booth filters, dry paint waste, and car dust (bondo dust) are generated at this shop. Operator stated that <br />all waste is taken to Tracy Material Recovery located at 30703 S. Macarthur Dr. Tracy, CA. Operator does not know <br />if waste is hazardous or not. <br />Note: Operator uses water based paint at this shop. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately stop disposal of bondo dust, paint booth filters, paint waste and make a <br />hazardous waste determination for each waste, including the three 55 -gallon containers with unknown contents and <br />manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other <br />knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in <br />Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br />determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br />hazardous waste generator status. <br />This is a minor violation. <br />Overall Inspection Comments: <br />An inspection checklist was provided to the facility operator on the day of inspection. A complete report was <br />finished on 10-22-2020 and replaces the initial checklist. <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, within 30 days of receiving the complete inspection report. <br />Documents provided during inspection: Return to compliance certification, Free CUPA classes flier, Oil filter <br />receipt, HHW Brochure, hazardous waste label, hazardous waste minimum labeling requirements sheet. <br />Waste streams found: Waste determination pending. <br />Note: total hazardous waste generated in 2019 could not be determined due to waste on site not managed as <br />FA0026146 PR0546198 SCO01 09/22/2020 <br />EHD 22-01 Rev. 9/16/2020 Page 4 of 5 Small Quantity Hazardous Waste Generator OIR <br />1868 E.
