activities will be temporarily stopped and California Department of Fish <br /> and Wildlife (CDFW) and/or U.S. Fish and Wildlife Service (USFWS) <br /> will be consulted as appropriate to determine what additional measures <br /> may be required to avoid impacts to such species. <br /> 3. Annual surveys for potential nest sites in the permit area shall be <br /> conducted prior to nesting season(December/January). All banks will be <br /> evaluated for potential nesting opportunities, such as crevices or shelves. <br /> In the event that any nesting material is found,it will be promptly removed <br /> and any potential nesting cavities filled in or removed to discourage <br /> nesting within the active permit area. In the event that actively nesting <br /> birds are found within the permit area, nests, eggs, and young will be <br /> avoided until the young have fledged unless appropriate permits are <br /> obtained. As discussed below, all employees and contractors will be <br /> subject to a Sensitive Species Training Program. A qualified biologist will <br /> be retained to make a determination as to when fledging has occurred. <br /> Alternatively,the site could be evaluated the following December/January <br /> during the annual survey for potential nest sites to determine a course of <br /> action. <br /> 4. A barbed wire fence will be placed around all the receiving pits with and <br /> along the Solid Waste Facility Permit Area at the direction of the <br /> owner/operator and Local Enforcement Agency (see Figure 4.2-1 for <br /> preliminary location and alignment). The final location of the perimeter <br /> fencing shall be as approved by and on file with the Local Enforcement <br /> Agency in plans submitted by the applicant. Fencing surrounding the <br /> active areas of the permit area will include small-mesh(1/4 inch diameter <br /> or smaller) exclusion fencing installed from 6 inches below ground level <br /> to at least 24 inches above grade to discourage wildlife from accessing the <br /> work areas. <br /> 5. A 15 miles per hour speed limit will be implemented on any nonpublic <br /> roads within the permit area. <br /> 6. Sensitive Species Training Program: As part of H.M.Holloway's Safety <br /> Training all employees and contractors will be trained to be aware of listed <br /> species which may be present and how to avoid impacts to them. Initial <br /> awareness training will be followed up by yearly refresher training. <br /> Firearms and pets are prohibited from the permit area. All food-related <br /> trash such as wrappers, cans, bottles, and food scraps will be disposed of <br /> in closed containers and regularly removed from the permit area. No <br /> deliberate feeding of wildlife will be allowed. If any listed species are <br /> observed within the permit area boundaries, a qualified biologist will be <br /> contacted to assist with avoidance of the species. <br /> *(bbb) Prior to the installation of fencing, all potential kit fox dens as identified in the <br /> biological reconnaissance report will be monitored and excavated per"U.S. Fish <br /> and Wildlife Service(USFWS)Standardized Recommendations for the Protection <br /> of San Joaquin kit fox Prior to or During Ground Disturbance" (Standardized <br /> Recommendations) (USFWS 1999). Six potential kit fox dens were observed in <br /> the additional.marshalling and stockpiling area(see Figure 4.2-2). If the status of <br /> any of the identified potential kit fox dens changes to known or suspected pupping <br /> den,the appropriate buffer as described in the Standardized Recommendations will <br /> be established around any such den and the USFWS and California Department of <br /> Fish and Wildlife(CDFW)will be contacted for further guidance prior to fencing <br /> GPA#7,Map#28; CUP#9,Map#28-Final Conditions <br /> T: 03/16/16-H:03/15/16 Page 9 <br />
