WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2010-0123 -4- <br /> H.M. HOLLOWAY, INC. <br /> H.M. HOLLOWAY SURFACE MINE LANDFILL PROJECT <br /> KERN COUNTY <br /> 22. First encountered groundwater also exceeds several agricultural water quality limits, <br /> including those for chloride, molybdenum, selenium, EC, and TDS. <br /> 23.Due to the nature of the occurrence of the groundwater in discreet sandy-lenses <br /> (see Finding No. 19), there is no discernable direction of groundwater flow, <br /> groundwater gradient, or groundwater velocity. <br /> 24.Waste constituents have not been detected above background concentrations in <br /> groundwater since monitoring began in 1995. <br /> WASTE CLASSIFICATION AND UNIT CLASSIFICATION <br /> 25.The Discharger disposes of nonhazardous solid wastes (see Finding Nos. 3 and 5) <br /> as defined in Section 20164 of Title 27. <br /> 26.Auto shredder waste typically contains concentrations of heavy metals and <br /> polychlorinated biphenyls (PCBs) in excess of total and soluble threshold limit values <br /> established for classification as hazardous waste in accordance with Title 22, <br /> California Code of Regulations, Section 66001 et seq. (Title 22). However, auto <br /> shredder waste characterized as hazardous, and whose generators have received <br /> approval from the Department of Toxic Substances Control in accordance with <br /> 66260.200(f) of Title 22, can be managed as a nonhazardous waste. <br /> 27.Waste determined by the Department of Toxic Substances Control for management <br /> as nonhazardous waste in accordance with. 66260.200(f) of Title 22, is classified as <br /> `designated' waste in accordance with Section 13173(a) of the California Water <br /> Code. <br /> 28.Section 20200(a)(1) of Title 27 allows the discharge of `designated' waste to waste <br /> management units other than Class II units, provided that the discharger establishes <br /> to the satisfaction of the regional water board, that the waste presents a lower risk of <br /> water quality degradation than indicated by its classification. <br /> 29. During separation of metallic materials from automobile shredder waste, the non- <br /> metallic portion undergoes a treatment process that stabilizes any heavy metals that <br /> are still present and results in a less reactive waste. <br /> 30.Treated auto shredder waste accepted for disposal has consistently contained <br /> concentrations of soluble PCBs, soluble metals, and volatile organic compounds <br /> that, based upon the site characteristics (see Finding Nos. 7, 8, 11, 20, 21, and 22), <br /> present a lower risk of water quality degradation at this site than indicated by its <br /> classification as a `designated' waste. <br /> 31.The site characteristics where the Units are located (see Finding No. 8) meet the <br /> siting criteria for a new Class III landfill contained in Section 20260(a) and (b)(1) of <br />
