Medical Waste Management Act(MWMA) <br /> Violation #93 Waste pharmaceuticals are not being transported pursuant to 118000 <br /> HSC or treated pursuant to 118215 HSC prior to disposal. Waste pharmaceuticals <br /> (pharmaceuticals returned by customers or pharmaceuticals that became waste as a result of <br /> contamination of some kind) are disposed of through a return logistics company and non-medical <br /> waste hauler named Genco also known as Capital Returns. Medical waste haulers are required to <br /> be registered hazardous waste haulers through the Department of Toxic Substances Control and <br /> approved to haul medical waste through the California Department of Public Health. Waste <br /> pharmaceuticals are required to be incinerated [or treated according to 118215(c)] pursuant to <br /> the MWMA. This is a violation of 118222(b) HSC. PLEASE NOTE THIS IS NOT A <br /> HAZARDOUS WASTE VIOLATION IT IS A CALIFORNIA MEDICAL WASTE <br /> MANAGEMENT ACT VIOLATION. <br /> Within 30 days, March 8, 2009, submit a plan for handling,storing, and disposing of <br /> waste pharmaceuticals pursuant to the California Medical Waste Management Act. <br /> Within 30 days, March 8, 2009, complete and submit a copy of the Return to <br /> Compliance Certification, found on the back of page 1, with a statement addressing <br /> how each of the above listed violations have been corrected. Submit all requested <br /> and necessary supporting documentation. <br /> Note:All EHD staff time associated with failing to comply by the above noted dates <br /> will be billed at the current hourly rate.
