Receipt of the response was <br />acknowledged by the SJCEHD inspector, Paul Nso, on 10/24/2019. Copies of are attached. Please remove this item from this inspection <br />report, as this was addressed as required in 2019. This is not a violation. <br />Violation #205 - Failure to submit a current UST Response Plan and have it available onsite. <br />® This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: This is not a violation, please remove this item from this report. <br />The Response plan was uploaded to CERS in January 2020 as required. A hard copy was available on site and was located in the local HMBP <br />plan. <br />A copy of the plan was additionally put in the UST binder on site. <br />Violation #319 - No spill bucket, failed to contain 5 gallons, no means to keep it empty, or failed to be tested. <br />❑ This violation was corrected © This violation will be corrected by (date): UST closure November 2020 <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />In communication with Paul Nso with SJCEHD (10/18/2019), the agreed on corrective action for this item <br />is to close the UST. Shell submitted an application to close the UST on 10/22/19 (submitted by Aaron <br />Swol with Brinderson, copy attached). The application to close out the UST was approved by SJCEHD, <br />Stacey Rivera, in March 2020. Shell has been moving forward with these plans, including obtaining <br />other agency permits required. The work to implement the UST closure plan is currently ongoing at the <br />terminal; contractors are on site. Aaron Swol with Brinderson (UST contractor), has been in <br />communication with Stacey Rivera of SJCEHD regarding the status, with UST closure expected in <br />November 2020. Shell is implementing the plan as agreed and communicated with SJCEDH. We <br />Rev. 8/27/2019 request that this item be removed from the inspection report. <br />1868 E.
