in writing of DTSC's approval or disapproval. <br />5.4. Concurrent with the submission of a FI Workplan, Respondent shall submit <br />to DTSC a Health and Safety Plan in accordance with Attachment E. If Workplans for <br />both an IM and FI are required by this Consent Agreement, Respondent may submit a <br />single Health and Safety Plan that addresses the combined IM and FI activities. <br />5.5. Concurrent with the submission of a FI Workplan, Respondent shall submit <br />to DTSC for approval a Community Profile in accordance with Attachment F. <br />CORRECTIVE MEASURES PROPOSAL (CMP) <br />6. Within 45 days of DTSC's approval of the FI Report, and the Risk Assessment <br />Report, Respondent shall submit to DTSC for review and approval a Corrective <br />Measures Proposal (CMP), if determined by DTSC to be necessary based on the FI <br />Report, which describes in detail the corrective measures proposed to protect human <br />health and the environment from the Constituents of Concern. The CMP must include <br />(1) a description of corrective measures to be implemented at the Facility; (2) an <br />explanation of how the proposed corrective measures are consistent with the FI Report, <br />the Risk Assessment Report, the IM Report (if required) and any Supplemental IM <br />Report (if required), applicable state and federal laws, their implementing regulations, <br />and applicable DTSC and United States Environmental Protection Agency guidance <br />documents; (3) proposed cleanup standards and points of compliance; (4) a detailed <br />description and schedule to construct and implement the corrective measures; and (5) <br />an analysis of at least two other alternative corrective measures considered before <br />proposing these corrective measure. The CMP shall also provide the basis and <br />justification for these proposals. <br />REMEDY SELECTION <br />7.1. If Respondent is required to prepare a CMP Report, DTSC will provide the <br />public with an opportunity to review and comment on the final draft of the CMP Report, <br />DTSC's proposed corrective measures for the Facility, and DTSC's justification for <br />LODI CHROME Docket SRPD RPDD06/07SCC-4378 <br />CORRECTIVE ACTION CONSENT AGREEMENT <br />6 <br />
