Manifest number 014052571JJK with the shipping date of 4-7-15 was found without a signed off copy from the destination facility. Facility lacked documentation of what was done to determine the status of the waste and lacked a copy of the Exception Report. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive e copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a repeat violation, Class II. 120 CCR 66266.81(a)(4)(B) Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. Bills of lading or manifests for the management of spent lead acid batteries for the last three years were not found on site. Receipts for lead acid battery sales were on site but they did not indicate how many spent lead acid battery cores were taken back by the vendor. A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the EHD. This is a repeat violation, Class II. 122 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on 8-8-14 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by 9-11-14. This information was received late on 10-6-15 resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Continue to ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report.
