Facility lacked documentation of what was done to determine the status of the waste and lacked a <br /> copy of the Exception Report. Hazardous waste generators shall retain copies of all manifests signed off by the <br /> destination facility on site for three years and have them readily available for review. If the generator did not receive e <br /> copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's <br /> waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall <br /> contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If <br /> the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste <br /> was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of <br /> the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste <br /> and the results of those efforts. Exception reports shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br /> the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br /> This is a repeat violation, Class II. <br /> 120 CCR 66266.81(a)(4)(B) Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br /> Bills of lading or manifests for the management of spent lead acid batteries for the last three years were not found on <br /> site. Receipts for lead acid battery sales were on site but they did not indicate how many spent lead acid battery <br /> cores were taken back by the vendor. A copy of each bill of lading must be kept on site for at least three years. <br /> Immediately locate a copy of all bills of lading or manifests for lead acid batteries for the last three years, maintain <br /> them on site, and submit copies to the EHD. <br /> This is a repeat violation, Class II. <br /> 122 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on 8-8-14 and an inspection report was issued identifying information to be submitted to <br /> bring this site into compliance. This information was required to be submitted by 9-11-14. This information was <br /> received late on 10-6-15 resulting in a non-compliant status for this facility. An operator that receives an inspection <br /> report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken <br /> or proposing corrective actions which will be taken.
