From the 16 August phone call and the data submitted, staff understands that <br /> Granite Construction proposed to discharge a quantity of burn dump waste from the Tracy area at <br /> Forward Landfill. The initial data provided by Granite indicated that the waste did not contain <br /> hazardous levels of any constituent but did not include a citric acid STLC test as required. Forward Inc. <br /> routinely requires that all appropriate testing be completed before waste is accepted, however because of <br /> a mix up 75 cubic yards of the burn dump waste were inadvertently discharged to the landfill. <br /> Subsequently, the waste was tested with the acid STLC method and found to contain 5.9 mg/l leachable <br /> lead, the hazardous level is 5.0 mg/l. The burn dump waste appears to be hazardous due to the leachable <br /> lead content. <br /> The Regional Board does not have the authority to issue a waiver to allow discharge of hazardous waste <br /> to a Class II landfill. Authority over the discharge of hazardous material is reserved to DTSC and <br /> Forward Inc. should apply to DTSC for a waiver as soon as possible. If you are unable to receive a <br /> waiver, Title 27 and your facility Waste Discharge Requirements require that the hazardous waste be <br /> removed. Staff understands that finding and removing the waste will be difficult. <br /> Additionally, Forward Inc. should review its waste acceptance procedures and tighten up procedures <br /> and/or make appropriate changes to prevent future occurrences such as this. <br /> If you have any questions, please call me at (916) 255-3814. <br /> ROSS D.
