Legal Description of Facility: <br /> The legal description of this facility is contained in appendix 7 of the Report of Disposal Site Information dated February, 1994. <br /> 13. Findings: <br /> a. This permit is consistent with the San Joaquin County Integrated Waste Management Plan,which was approved by the CIWMB <br /> on February 18, 1992. The location of the facility is identified in the Nondisposal Facility Element,pursuant to Public Resources <br /> Code(PRC), Section 50001(a). <br /> b. This permit is consistent with the standards adopted by the CIWMB,pursuant to PRC 44010. <br /> c. The design and operation of the facility is consistent with the State Minimum Standards for Solid Waste Handling and Disposal as <br /> determined by the enforcement agency,pursuant to PRC 44009. <br /> d. The Linden-Peters Fire Department has determined that the facility is in conformance with applicable fire standards,pursuant to <br /> PRC,44151. <br /> e. A Notice of Determination was filed with the State Clearinghouse(SCH#93102034)and certified by the San Joaquin County <br /> Community Development Department on December 1, 1993. The Notice of Determination describes and supports the design and <br /> operation which will be authorized by the issuance of this permit. A Notice of Determination was filed with the State <br /> Clearinghouse on December 20, 1993. <br /> f. The following authorized agent has made a determination that the facility is consistent with,and designated in,the applicable <br /> general plan: San Joaquin County Community Development Department,Planning Division. Public Resources Code, Section <br /> 50000.5(a) <br /> g. On December 20, 1993,the San Joaquin County Community Development Department, Planning Division made a written finding <br /> that surrounding land use is compatible with the facility operation,as required in Public Resources Code, Section 50000.5(a) <br /> h. On December 19,2001,from the San Joaquin County Community Development Department,Planning Division reviewed SA 93- <br /> 41 and made a written finding that the proposed changes are consistent with the sites existing site approval. <br /> 14. Prohibitions: <br /> The permittee is prohibited from accepting the following wastes: <br /> Hazardous,radioactive,medical(as defined in Chapter 6.1,Division 20 of the Health and Safety Code),liquid,designated,or <br /> other wastes requiring special treatment or handling,except as identified in the Report of Facility Information and approved <br /> amendments thereto and as approved by the enforcement agency and other federal,state,and local agencies. The permitte is <br /> additionally prohibited from the following items: Liquid wastes or slurries,Medical wastes,Dead animals,Hazardous wastes and <br /> designated wastes,Ash, Sludges,Food wastes,Cannery wastes and Contaminated soil. <br /> 15.
